CHAP. 288.—An ACT to amend and re-enact subsection 5 of section 2070-a
of an act approved May 14, 1903, entitled an act to amend and re-enact
chapter 95 of the Code of Virginia, in relation to the preservation of
certain birds and animals and to prevent unlawful hunting, and to
repeal certain sections of the Code, etc., as further amended and re-
enacted as to subsection 2 of section 2070-a by an act approyed March
14, 1904, as further amended and re-enacted as to section 2070-a by an
act approved March 15, 1906, as further amended and re-enacted by
an act approved March 11, 1908, and further amended and re-enacted
by an act approved March 16, 1910, as to certain counties.

1. Re it enacted by the general assembly of Virginia, That
subsection five of section two thousand and seventy-a of an act
approved May, fourteenth, nineteen hundred and three, entitled
an act to amend and re-enact chapter ninety-five of the Code of
Virginia, in relation to the preservation of certain birds and ani-
mals, and to prevent unlawful hunting, and to repeal certain sec-
tions of the Code, and so forth, as further amended and re-enacted
as to subsection two of section two thousand and seventy-a by an
act approved March fourteenth, nineteen hundred and four, as
further amended and re-enacted as to section twenty hundred and
seventv-a by an act approved March fifteenth, nineteen hundred
and six, as further amended and re-enacted by an act approved
March eleventh, nineteen hundred and eight, and further amended
and re-enacted by an act approved March sixteenth, nineteen
hundred and ten, as to certain counties, be amended and re-
enacted so to read as follows:
5. The board of supervisors of any county shall have the
power to shorten the open season in their said county, and by
regulations not inconsistent with the provisions of this section
may further protect the game within their said county, and may
include in such protection other game not specifically mentioned
in this section; provided, that it shall be lawful to ship out of the
State wild water fowl legally killed in the counties of Accomac,
Northampton, Norfolk and Princess Anne.
And wild water fow] may be shot at night in the counties of
Essex, Richmond and Westmoreland.
But in shooting any game in this State no gun larger than
a ten bore may be used, this to be shot from the shoulder, and no
person shall be allowed to shoot more than one gun at a time or
to shoot a battery of guns; provided, this act shall not apply to
Back bay or its tributaries, in Princess Anne county; and pro-
vided, further, it shall be lawful to ship within or without the
State wild water fowl legally killed.
8. All acts or parts of acts in conflict with this act are hereby
repealed.
