Chap. 209.-An ACT to authorize and direct the register of the land office
to grant and convey unto R. Henry Moore, of Elizabeth City county,
not exceeding ten acres in area near the easterly end of Hampton
bar or flat, for the construction and maintenance of a landing and
shipping place, with piers and jetties therefrom.

1. Be it enacted by the general assembly of Virginia, That
when R. Henry Moore, of Elizabeth City county, shall pay into
the treasury seventy-five (75) cents for each acre applied for
by him, and the treasurer of Virginia, shall have given him a
receipt for the money paid therefor and such receipt shall have
been delivered to the auditor of public accounts, the auditor
of public accounts shall thereupon deliver to the said R. Henry
Moore, a certificate stating the number of acres to which he may
be entitled under this act; and thereupon the register of the
land office shall forthwith issue and deliver a good and sufficient
grant from and on behalf of the commonwealth to the said R.
Henry Moore, conveving to him not exceeding ten (10) acres
on Hampton bar, where the water at ordinary low tide does not
exceed five (5) feet in depth; provided, however, that before the
treasurer shall accept any payment from the said R. Henry
Moore, the latter shall present to him a certificate from the
commission of fisheries or the commissioner of fisheries, describ-
ing as accurately as may be, with due reference to fixed points
on high land, that portion of the “bar” or flats applied for by
the said R. Henry Moore, stating the area applied for thereof,
and further certifying that the part of the flat applied for is no
part of any natural ovster beds, rocks or shoals, and is not adapt-
able for ovster planting ground.
2. That when the said R. Henry Moore shall have complied
with the provisions of this act, and the register of the land
office shall have granted and conveyed to him the portion of the
“bar” or flat so applied for, then and thereafter, the said R.
Henry Moore, his heirs, personal representatives and assigns,
shall be and they are hereby authorized to construct and main-
tain such landing and shipping place thereon, with piers and
jetties extending therefrom, as to him or them may seem
proper; and to utilize the same for any purposes not in con-
flict with the laws of this State or the United States, and to
that end he and they are authorized and empowered to deepen,
by dredging or otherwise, the waters adjacent to such landing
and shipping place; provided, however, that in constructing and
maintaining such landing and shipping place, piers and jetties,
the said R. Henry Moore, his heirs, personal representatives and
assigns, shall fully comply with the acts of congress for such
cases made and provided, and shall not conflict with the rules
and regulations of the war department of the United States re-
lating to navigation.
