Chap. 205.—An ACT to authorize the board of supervisors of Rockingham
county. In the State of Virginia, to establish toll gates for the pur-
pose of maintaining the macadam roads in said county.
Approved March 13, 1912.
1. Re it enacted by the general assembly of Virginia, That
the board of supervisors of Rockingham county, in the State of
Virginia, shall be empowered to erect and maintain toll gates if,
in their discretion, they deem it proper to do so; and to demand
and collect tolls on all the macadamized roads in said county
except those hereinafter exempted; and the rate af toll to be
fixed by the said board of supervisors; provided, however, that
the said rates shall not exceed those fixed by the general law for
turnpikes.
2. That the road boards of the respective magisterial dis-
tricts shall have exclusive charge and control of all the macada-
mized roads, and shall be charged with the duty of collecting and
disbursing all tolls collected from said roads in the said respec-
tive districts.
3. That there shall be but one toll gate to every five miles or
fraction thereof, and on such fraction the rate charged shall be
pro rata to the five mile rate.
4. That all the tolls collected from any one of such macada-
mized roads shall be expended in maintaining the road from
which said tolls were collected.
5. That the board of supervisors of said county shall have
the power, if they deem it wise and proper to exercise the same,
to give a rebate in tolls to those who have made, or shall here-
after make, private subscriptions to the building of permanent
macadam roads in said county on any road where toll gates shall
be established; and said rebates shall be in such amounts as the
board of supervisors shall determine, but not to exceed in any
case the amount of said private subscription.
6. That the provisions of this bill shall not apply to those
macadam roads in said county which are being built under the
provisions of other special laws.
