Chap. 151.—An ACT to amend an act approved March 4, 1896, entitled
“An act providing for the working, opening, and keeping in repair
the roads in the county of Lunenburg, and for the building and
keeping in repair the bridges in said county,” by adding a new
section (14-a) thereto, providing for submitting to the qualified voters
of the several magisterial districts in Lunenburg county, the question
as to the issuance of bonds bv such magisterial districts for the con-
struction and repair of the publi¢ roads in said magisterial districts.

1. Be it enacted by the general assembly of Virginia, That
an act approved March fourth, eighteen hundred and ninety-six,
entitled “An act providing for the working, opening, and keep-
ing in repair the roads in the county of Lunenburg, and for the
building and keeping in repair the bridges in said county,” be
amended by adding a new section (14-a) thereto, providing for
submitting to the qualified voters of the several magisterial dis-
tricts in Lunenburg county the question as to the issuance of
bonds by such magisterial districts for the construction and re-
pair of the public roads in said magisterial districts, in the fol-
lowing words, to-wit:
§14-a. Be it further enacted, That bonds may be issued by
any magisterial district in the county of Lunenburg, Virginia,
for the purpose of macadamizing or otherwise permanently im-
proving the public roads of any magisterial district in said county
upon the conditions hereinafter provided for. The circuit court
of the said county, upon the petition of twenty or more freehold-
ers of any magisterial district in said county, shall make an order
requiring the judges of election at the next regular election there-
after to be held in said county for the election of county or
State officers, or at any other time not less than thirty days from
the date of such order, which shall be designated therein, to open
a poll and take the sense of the qualified voters of such magis-
terial district whether the board of supervisors shall issue bonds
for said purposes, or either of them. The said order shall desig-
nate the magisterial district or districts in which said road or
roads lie, and the maximum amount of bonds to be issued, which
shall in no case exceed an amount in excess of ten per centum of
the total taxable values at the time in the magisterial district in
which the road or roads are to be built or permanently improved.
The qualified voters at any special election held under this act
shall be those qualified to vote at special elections under existing
laws. The duration or length of time said bonds are to run and
be payable, as well as the rate of interest to be paid thereon,
shall be designated in said order, and said bonds shall be re-
deemable at the pleasure of the board of supervisors on behalf
of the said magisterial district after five years from the date of
issuance, or any other time fixed in the order. In the event a
majority of voters of such district or districts are in favor of
issuing such bonds, for the purpose aforesaid, the circuit court
shall at its next term enter of record an order requiring the su-
pervisors of the county to proceed at their next meeting to carry
out the wishes of the voters as expressed at said election. The
said board of supervisors shall have power to appoint an agent
or agents to sell said bonds, provided that said bonds shall be
sold to be paid for in lawful money only, and shall not at a price
less than par value. When such a sale of bonds has been nego-
tiated, the board of supervisors shall issue the same. Such bonds
may be either registered or with coupons attached as said board
of supervisors prescribe, and shall have written or printed in
each the following sentences: :
These bonds are issued for road improvement in
magisterial district of Lunenburg county, Virginia, and the full
faith and credit of said district is hereby pledged for their pay-
ment, and a tax is to be levied upon the property in said district
by board of supervisors of said county to pay the interest on
them and to create a sinking fund sufficient in amount to pay the
principal upon maturity. Said bonds shall be signed by the
chairman of the board of supervisors of said county and counter-
signed by the clerk thereof under the seal of the said board. The
said bonds shall be in denominations of one hundred dollars, or
some multiple thereof; and shall bear interest at a rate not ex-
ceeding six per centum per annum, payable annually, at the office
of the treasurer of said county on the first day of July of each
year and shall be payable not exceeding thirty-four years from
the date thereof at said office, but may, in the discretion of the
said board of supervisors, be made redeemable at such time or
times or after such period or periods and upon such notice as the
said board may prescribe and stipulate upon the face of the bonds
when issued.” ,
Such election shall be held and returns thereof certified and
canvassed in all respects, as is provided by an act approved Feb-
ruary twenty-eighth, nineteen hundred and eight, entitled “An
act to provide for the issuing of county bonds for permanent
road or bridve improvement in the magisterial districts of the
counties of the State,’ and the bonds when issued shall be sold
and the proceeds thereof collected by the treasurer of said coun-
ty, as is also provided by said act ot February twenty-fifth,
nineteen hundred and eight, and the money arising from the pro-
ceeds thereof shall be applied to the purposes for which they were
issued for macadamizing and otherwise permanently improving
the roads of such district under the supervision, management
and control of a board consisting of five freeholders of such mag-
isterial district to be selected and appointed by the judge of the
circuit court of Lunenburg county in term time or vacation, who
before entering upon the duties of their office shall execute bond
payable to the board of supervisors of Lunenburg county in such
amount and with such security as will be approved by said court
or judge, and conditioned for the faithful performance of their
duties as such commissioners under such appointment, and to
account for all of said funds which may come into their hands,
said board so appointed to be known as the road board of the
magisterial district for which they were appointed. They are
to make contracts for the improvement of the roads and bridges
in said district so far as the same are constructed or improved
out of said fund arising from the sale of said bonds, and are to
make reports of their proceedings to the board of supervisors of
said county whenever called upon to do so. All such work shall
be done in accordance with the plans and specifications provided
by and under the general supervision of the State highway com-
missioner, and the State highway commissioner shall appoint
an engineer or superintendent to supervise the construction of
all work done under the provisions of this section. The treas-
urer of said county shall pay and expend the money arising from
the sale of said bonds upon the order of said board of road com-
missioners of such district to be signed by the chairman of the
board and countersigned bv one of the members thereof to be
designated as secretary. The treasurer receiving said funds
into his hands shall make final settlement thereof, when the
same is fuily disbursed, with the said board of road commis-
sioners for such district, which statement shall be referred to
and approved by the board of supervisors of such county, and
the said board of road commissioners for such district shall be
authorized at any time they may think proper to do so, to call
upon the treasurer for a statement as to the condition of said
fund.
An emergency existing this act shall be in force from its
passage.
