Chap. 10.—An ACT to authorize any city, town or county of this Common-
wealth to use the waters of Lake Drummond for the purpose of a supply
of water to itself or its inhabitants, and to acquire by purchase, con-
demnation or otherwise sufficient lands along the shores of said lake
and water, and water rights for the establishment of its water works,
pumping stations and other necessary works.

Whereas, certain municipal corporations of this Common-
wealth are in need of an ample supply of pure and wholesome
water; and
Whereas, Lake Drummond, situated in Norfolk and Nanse-
mond counties, in the State of Virginia, contains such an ample
supply of pure and wholesome water; and
Whereas, the State of Virginia has, for more than a century
from time to time, granted to certain individuals and corpora-
tions the right to use the waters of said lake and has regulated
the right to build wharves on the shores of said lake, and the
right to fish in the said lake, as evidenced by the following acts of
the general assembly of Virginia, to-wit: An act passed Decem-
ber first, seventeen hundred and eighty-seven, incorporating the
Dismal Swamp Canal Company, and authorizing it to use the
waters of said lake, so far as might be necessary for its pur-
poses; an act entitled an act incorporating the Portsmouth and
Lake Drummond Water Company, passed March fifteenth,
eighteen hundred and fifty-six, creating said company and au-
thorizing it to construct the works necessary to convey water to
the town of Portsmouth from Lake Drummond; an act entitled
an act to incorporate the Portsmouth and Lake Drummond and
Marine Water Company, passed April twenty-fifth, eighteen
hundred and sixty-seven, creating said company for the purpose
of supplying Portsmouth, and the shipping in the harbor with a
copious and never failing stream of pure water from Lake
Drummond; an act entitled an act to incorporate the Ports-
mouth Water Company, approved February, eighteen hundred
and seventy-nine, amended by an act approved February twenty-
seventh, eighteen hundred and _ seventy-nine, and further
amended by an act approved January twenty-fifth, eighteen
hundred and ninety, creating said company and authorizing it
to convey water from Lake Drummond to Portsmouth, and to
the United States navy yard and hospital; an act entitled an act
to incorporate the Dismal Swamp LumBer Company, approved
March twenty-seventh, eighteen hundred and _ seventy-three,
creating said company and authorizing it to build all necessary
wharves on Lake Drummond for the proper and successful man-
agement of its business; an act creating the Virginia Water
Company, approved February sixteenth, eighteen hundred and
ninety-two; an act entitled an act to prohibit the catching of
fish with seines, weirs and nets in Lake Drummond, approved
February twenty-sixth, eighteen hundred and ninety-six; an act
approved March third, nineteen hundred, entitled an act to re-
enact an act entitled an act to prohibit the catching of fish with
seines, weirs and nets in Lake Drummond, approved February
sixth, eighteen hundred and ninety-six; therefore
1. Be it enacted by the general assembly of Virginia, That
any citv, town or county of this Commonwealth may use the
waters of Lake Drummond in so far as the said waters, or the
use thereof, have not heretofore been granted or disposed of by
the State of Virginia, for the purpose of furnishing to itself and
its inhabitants a supply of water, and for that purpose may
acquire by purchase, condemnation or otherwise, sufficient lands
along the shores of said lake, and water, and water rights,
whether such land, water and water rights be owned by indi-
viduals, private corporations or public service corporations, for
the establishment and operation of its water works, pumping
stations, etcetera, and all other necessary works.
2. All acts or parts of acts in conflict with this act are hereby
repealed.
