Chap. 22.—An ACT to amend and re-enact section 3022 of the Code of Vir
ginia, 1887, in relation to award of writ of quo warranto.

1. Be it enacted by the general assembly of Virginia, That sectior
three thousand and twenty-two of the Code of Virginia, eighteen hun
dred and ecighty-seven, be amended and re-enacted so as to read as fol
lows:
$3022. In what cases writ of guo warranto awarded.—A writ of que
warranto may be awarded and prosecuted in the name of the State o
Virginia in any of the following cases, to-wit. :
First. Against a corporation (other than a municipal corporation) fo
a misuse or non-use of its corporate privileges and franchises, or for th:
exercise of a privilege or franchise not conferred upon it by law, 01
where a charter of incorporation has been obtained by it from a court oi
the State corporation commission for a fraudulent purpose, or for a pur.
pose not authorized by law.
Second. Against a person for the misuse or non-use of anv privilege
and franchise conferred upon him by or in pursuance of law.
Third. Against any person or persons acting as a corporation (othe
than a municipal corporation) without authority of law; and,
Fourth. Against any person who shall intrude into or usurp any pub
lic office. But no such writ shall be awarded or prosecuted against an)
person now in office for any cause which would have been available in
support of a proceeding to contest the election of such person to sucl
office.
