Chap. 79.—An ACT to establish a general road fund for the permanent improve-
ment of the roads and the bridges of Dinwiddie county; to create a road board
for Dinwiddie county, and to prescribe its powers and duties; and to provide
for the appointment of a county superintendent of roads, and to regulate )is
duties.
Approved March 8, 1904.
1. Be it enacted by the general assembly of Virginia, That the board
of supervisors of Dinwiddie county shall create a general road fund by
setting apart and appropriating thereto one-half the road fund of each
district of said county in each year, including the levies for the year
nineteen hundred and three, which general road fund and such other
moneys as may be lawfully appropriated thereto, shall be expended an-
nually towards the permanent improvement of the public roads of said
county as is contemplated by this act.
2. There is hereby created a board, to be known as the road board for
Dinwiddie county. The said road board of Dinwiddie county shall con-
sist of one member from cach magisterial district and one member from
the county at large, to be appointed within thirty days after the passage
of this act by the judge of the circuit court for the county of Dinwiddie,
in term time or in vacation, and shall hold office until the first day of
July, nineteen hundred and five. On or before the first day of July,
nineteen hundred and five, and annually thereafter, the judge of the said
circuit court, in term time or vacation, shall appoint the members of
said road board for Dinwiddie county. The members of said road board
for Dinwiddie county shall not hold any other office during their con-
tinuance in office. The said road board for Dinwiddie county shall take
charge of and have the general supervision and control of all of the roads
in Dinwiddie county. It shall have authority, and it shall be its duty,
to designate the roads in each district to be improved under the pro-
visions of this act, and to specify the character of improvement to be
made on each road, and shall thereupon cause such road or roads, or
parts of roads so designated to be built, improved or repaired in a per-
manent manner, or as nearly so as may be practicable.
3. The road board for Dinwiddie county, as soon as practicable after
its appointment, shall organize by electing one of its members chairman
and another secretary, and shall appoint a county superintendent of roads
for the term of one year from the date of his appointment, and, from
time to time, fix his compensation and prescribe his duties, where they
are not prescribed by this act; and said road board for Dinwiddie county
may remove such superintendent from office, and may, from time to
time, if deemed by it necessary, appoint a deputy, or deputies, for said
superintendent, upon his request, for such times as it may direct, but
not extending beyond the term of superintendent, and fix the compensa-
tion of such deputies; and said road board for Dinwiddie county shall
have authority to appoint all other agents or engineers as it may deem
necessary, prescribe their duties and fix their compensation, and shall
have full power to purchase machinery, teams, supplies, and materials,
and: to perform all other acts necessary to carry out the spirit of this act.
It shall also have authority to forbid the public from travelling on any
road, or portion of road, while the same is being built, improved, or re-
paired ; and thereafter, when such travel would by weather conditions, in
the opinion of said board, greatly damage such road. It may make all
necessary contracts, and shall require proper bonds from all agents and
contractors for the faithful performance of duties or contracts. All
work and contracts shall be done and performed to the satisfaction of
the road board for Dinwiddie county, and all moneys shall be paid by
the warrant of the board of supervisors upon a certificate frofn the said
road board for Dinwiddie county that said work or contracts have been
faithfully done and performed.
4. The member of the road board for Dinwiddie county from each
magisterial district, and the member of the said board from the county at
large, together with the county superintendent of roads, shall constitute
the district road board for said magisterial district; each district board
shall have the immediate control and supervision of all work done or
performed on the roads of the district under the provisions of this act.
5. The board of supervisors shall annually levy, along with the county
levy, a special tax upon the property, real and personal, assessed for tax-
ation in the county of Dinwiddie, which, together with the county levv
received from railroad, canal, telegraph, and telephone companies, shall
be applied by said board to building, repairing, improving, and keeping
in order the public roads and bridges in said county, upon the certificates
of said road board for Dinwiddie county, as provided for in this act.

Such special tax shall not be less tham five nor more than twenty cents
on every one hundred dollars in value of such property, and shall be
collected, accounted for, and paid out as the general county levy.
6. The said board of supervisors shall have the authority to appro-
priate to the general road fund provided for by this act any balance that
may remain at the end of any fiscal year to the credit of the county fund
or levy, or so much of said balance as said board may deem it wise to
appropriate; and said board may at any time appropriate to said general
fund sums from the county levy as it may deem necessary and proper, in
addition to the special tax hereinbefore provided for and the county levy
received from railroad, canal, telegraph, and telephone companies.
%. No supervisor or public officer, member of the road board for Din-
widdie county, superintendent of roads, deputy or engineer, shall have
any pecuniary interest in any work or contract done or had under the
provisions of this act, except that the said superintendent of roads and
his deputy or deputies, and such agents or engineers as may be employed,
may receive such compensation as may be fixed by the said road board
for Dinwiddie county; and except further, that the said road board for
Dinwiddie county may appoint the county surveyor as county superin-
tendent of roads. .
8. The members of the road board for Dinwiddie county hereby
created, and the superintendent of roads, shall qualify by taking the
usual oath for the faithful performance of their duties. _
9. All acts or parts of acts in conflict with this act are hereby repealed.
