Chap. 47.—An ACT to provide for working and keeping in repair the roads and
bridges in the counties of Sussex and Greensville, and providing what tax shall
be used for keeping the same in order.
Approved March 2, 1904.
1. Be it enacted by the general assembly of Virginia, That from and
after the passing of this act the manner of working, repairing, and main-
taining the roads and bridges in the counties of Sussex and Greensville
shall be as follows: It shall be the duty of the judge of the circuit court
of Sussex and Greensville counties, during the month of May, or as soon
thereafter as practicable, to appoint from each magisterial district in said
counties, one tax-payer and voter living in said magisterial district; and,
furthermore, to be a man of good judgment and possess a practical
knowledge of road-making, who shall be known as the road commissioner,
and whose term as said commissioner shall be four years, unless sooner
removed by said circuit judge for neglect of duty, or any other reason
which, in his judgment, shall seem proper and sufficient, or on motion of
board of supervisors.
2. It shall be the duty of the road commissioner, as soon as practi-
cable, after being notified of his appointment by the clerk of the circuit
court, to proceed at once to divide all of the public roads in his said dis-
trict into sections of not more than five miles each, to be numbered,
described, and known as “road section number in dis-
trict.” The road commissioner shall estimate what amount will be
necessary for the repairing and keeping in order of all roads and bridges
within each road section, taking in consideration the probable amount
coming to his district as reported to him by the county treasurer, said
amount known as district “road tax.”
3. It shall be the duty of the road commissioner in each district, as
soon as the said roads are made into sections as provided, to advertise
such sections as the commissioner sees fit, for not less than five days, in
four or five public places in said district, setting forth and describing
said sections to be let, on what date, hour and place of letting, and each
section shall be let to the lowest bidder, no bidder to undertake any other
section of road until he has fully complied with all the conditions set
forth in the contract as between the contractor and road commissioner ;
contract shall be in writimg, and shall set forth in minute detail what
work is to be done on said section of road, and the amount to be paid for
same, the time allowed in which to complete said section of road, and
the contractor shall not receive any pay until he, the said contractor, has
fully complied with all of the conditions expressed or contained in said
contract between said contractor and road commissioner. But when
said contract has been fully complied with on the part of the contractor,
the road commissioner shall certify the claim to the board of supervisors
for payment, and the board of supervisors shall pay the same.
4. The road commissioner shall keep an accurate account of all work
done, amounts paid out, and names of contractors, and render an annual
statement in writing, under oath, to the boards of supervisors of the said
counties. And should a road commissioner of a district be unable to
get contractors for any section or sections, then the commissioner shall
himself hire labor to do such work as may be actually necessary, in order
that public travel may not be obstructed, and render an itemized state-
ment in writing, with proper vouchers, under oath, showing the amount
on account of labor, teams, wagons, or other implements used in working
said sections, to the board of supervisors of said counties.
6. The road commissioners of the several districts of the said counties
shall each receive as their compensation the sum of two dollars per day
for each day he is actually engaged in the performance of his duties
under this act: provided, that no commissioner shall receive more than
one hundred dollars in any one year for his services as such commis-
sioner. ,
7. It shall be the duty of the said road commissioner to give to each
section of road in their respective districts their proportionate part of
said funds, to be expended on roads in said districts, taking into con-
sideration the nature of the road to be worked.
8. The board of supervisors are required under this act to give to each
district all funds arising or derived from the taxing of dogs in said dis-
trict (after paying commissions that may be due the treasurers of the
counties from this source and damage to stock). This fund shall be
known as “the permanent improvement road fund.”
9. All acts and parts of acts in conflict with this act are, to this ex-
tent, repealed. This act shall be construed to repeal the general law on
roads only to the extent it conflicts therewith.
