Chap. 36.—An ACT to amend and re-enact an act entitled an act to amend and
re-enact section 3154 of the Code of Virginia, as amended by act approved
January 11, 1904, in relation to selection and peremptory challenge of jurors in
civil cases.
Approved February 27, 1904.
1. Be it enacted by the general assembly of Virginia, That section
three thousand one hundred and fifty-four of the Code of Virginia as
amended by act approved January eleventh, nineteen hundred and four,
be amended and re-enacted so as to read as follows:
§3154. The court shall, on motion of either party in any suit, exam-
ine on oath any person who is called as a juror therein to ascertain
whether he is related to either party, or has any interest in the cause,
or has expressed or formed any opinion, or is sensible of any bias or
prejudice therein; and the party objecting to any juror may introduce
any competent evidence in support of the objection; and if it shall ap-
pear to the court that the juror does not stand indifferent in the cause,
another shall be drawn or called and placed in his stead for the trial of
that cause.
And in every case the plaintiff and defendant may each challenge one
juror peremptorily, where the jurv consists of seven.
2. By reason of the new court system being now in operation an emer-
gency exists, therefore this act shall be in force from its passage.
