2. Such repeal shall not affect or impair any act done or right estab-
lished, accruing, accrued, or acquired, or any liability, penalty, forfeiture,
or punishment incurred prior to the passage of this act, under or by virtue
of any provision of the acts of the general assembly, or amendments
thereof, repealed by the preceding section ; but the same may be asserted,
enforced, prosecuted, or inflicted as fully and to the same extent as if the
same had not been repealed. All actions and! proceedings, civil or crimi-
nal, commenced under or by virtue of any provision of the acts of the
general assembly, or amendments thereof, repealed by the preceding sec-
tion, pending at the date of the passage and approval of this act, may be
prosecuted and defended to final effect in the same manner as they might
under the laws then existing, unless it shall be otherwise specially pro-
vided by law. Nothing in this act contained shall be construed to impair
the charter of any corporation existing at the date of the passage and ap-
proval of this act, or any right or liability which any existing corporation,
its officers, directors, stockholders, or creditors may have or be subject to,
or which any corporation had or was subject to, at the date of the passage
and approval of this act, by virtue of any provsion of the acts of the gen-
eral assembly or amendments thereof, repealed by the preceding section.
38. An emergency existing for the immediate passage of this act, the
same shall be in force from its passage.
