Chap. 245.—An ACT to authorize the city of Newport News to issue bonds for the
payment of the balance of the contract price for paving Washington avenue and
- Twenty-fifth street, in said city, and to repeal all of the acts heretofore attempt:
ing to give this authority to said city.

Whereas, by an act. approved J anuary twenty-seventh, nineteen hun-
dred and three, the said city of Newport News was authorized to issue
bonds for the: payment, of the, balance of the contract price for paving
Washington avenue and Twenty-fifth street; and,
Whereas, in the passage of the said act the journal of the henge of dele-
gates does not show any negative vole taken upon the passage of the said
act, which counsel for the bond purchasers deemed necessary; and,
Whereas, in the passage of another act on the thirty-first day of De-
cember, nineteen hundred and three, attempting to ratify and confirm
the sale of the said bonds so made in pursuance of the above act by the
council of the.said city, the journal of the house of delegates does not
show any negative vote taken for the passage of the said act, which coun-
sel for the bond purchasers deemed necessary; therefore,
1. Be it enacted by the general assembly of Virginia, That im addition
to the present indebtedness of the city of Newport News and the certifi-
cates of debt or bonds which the council of the said city is otherwise au-
thorized by law to issue, the common council of the said city may, in the
name and for the use of the said city, cause to be issued certificates of
debt or bonds (the form of which shall be prescribed by the council) in
the amount of fifty-six thousand dollars, payable in United States cur-
rency, bearing a rate of interest not exceeding six per centum per annum,
and payable, in the discretion of the council, in not less than twenty nor
more than forty years from their date: provided, however, that the money
art from the sale of said bonds shall be used and applied by the said
city to the payment of any indebtedness it may have incurred and re-
maining unpaid in the paving heretofore done on Washington avenue and
Twenty-fifth street in said city.
2. That the council of said city is hereby authorized to confirm and
ratify the sale heretofore attempted to be made of the said bonds, and to
have the same delivered in accordance therewith.
_ 3. That all acts or parte of acts heretofore enacted for the issuance,
sale, and delivery of the bonds for the above purpose shall be, and they
are hereby, repealed.
4. This act being an emergency one, in that the said city has offered
for sale and accepted bids for the said bonds, it shall be in force from its
passage.
