Chap. 83. —An ACT to amend the aet passed Mareh od. 1866, entitled an
aet to amend and reenact the 45d section of chapter 172 of the Code
of JTS, ,

1. Be it enacted by the general assembly, That the act
passed March the third, ciekieen hundred and sixty-six, en-
titled an act to amend and re-enact the forty-third section of
chapter one hundred and seventy-two of the Code of eigh-
teon hundred and sixty, be amended and re-enacted so as to
read as follows:

re-enacted so as to read as follows:
@ 945. There need be no such enynuiry in an action of debt,
upon any bond or other writing for the payment of money,
or against the drawer or endorser of a bill of exchange or ne-
gotiable note, or in an action of debt, scire facias, upon a
judgement or recognizance, or in any action of assumpsit:
provided. the plaintiil’ shall serve the defendant, at the same
time and in the same manner that the process or summons to
commence the suit or action is served, with a co opy (¢ ‘ertified
by the clerk of the court m which the suit or action is brought.)

distinctly the several items of his oldu, and the aggregate
smount thereot and the time from which he claims interest
thereon, and the credits, fany, to which the defendant may
be entitled thereon. But this act shall not apply to any ac-
tion of assumpsit in which the prHELKS is served by publi-
cation.’
