Chap. 66.—An ACT to amend an act entitled an act in regard to Aban-
doned:Turnpikes, passed February 16, 1866. '
Passed January 15, 1867.
1, Be it enacted by the general assembly, That the act
ntitled an act in regard to abandoned turnpikes, passed
february sixteenth, eighteeh hundred and sixty-six, be
mended and re-enacted so as to read as follows: _
“§ 1. That whenever any turnpike company shall have
bandoned its road, or a part thereof, the county court of the
ounty in which such road lies, may appoint surveyors, and
ssign hands to work on said road, or part thereof, lying in
aid county;.and the hands so assigned shall be, in all re-
pects, subject to the provisions of section twenty-eight,
chapter sixty-seven, of the Code of Virginia, (edition of
eighfeen hundred and sixty).
“§2. The county courts of the state may take charge of
such abandoned turnpikes, and have them repaired and put
in good condition; to defray the expenses of which, they are
authorized to erect toll gates thereon, subject to the limita-
tions of the general turnpike laws; and said tolls are to be
faithfully applied to keeping said turnpikes i in good and law-
fil repair.
«ey 3. In the event that said county courts cannot procure
a suitable person or persons to put said roads in good condi-
tion fot the tolls on the same, they are further authorized to
borrow money for such purpose, and pay the same out of’the
moneys arising from tolls on said roads.
