Chap. 218.—An ACT authorizing the County Court of Lee County to
authorize Charles W. Roop and Josiah Wynn, of said county, to con-
struct a Dam across Powell’s river.
’ * Passed February 19, 1867.
1. Be it enacted by the general assembly, That the county
court of Lee, all the magistrates of said county having been
summoned for this‘ purpose, and a majority thereof being
present, be and they are hereby authorized and empowered
to grant leave to Charles W. Roop and Josiah Wynn, of said
county, to construct a grist and aw mill dam across Powell’s
river, in said county, if in their opinion it shall be the inte-
rest of the citizens of said county to have the said dam con-
structed; and said dam, when constructed, shall be subject to
all the provisions of chapter sixty-three of the Code of Vir-
ginia applicable thereto. |
2. This act shall be in force from its passage, and shall be
subject to modification, amendment or repeal, at the pleasure
of the general assembly.
Chap. 219—An ACT authorizing William Smith, late Sheriff of Mont-
gomery county, to Collect Taxes advanced and paid into Treasury by
him, which were due prior to the lst January, 1861.
Passed February 20, 1867.
Whereas William. Smith, late sheriff of Montgomery
county, whose term of office expired on the first day of Jan-
uary, eighteen hundred and sixty-ong, has been prevented by
the war from collecting the amount due him, as provided by
the fourth section of chapter thirty-six of the Code of Vir-
ginia, notwithstanding he has advanced and paid the whole
revenue of the county into the treasury of the state: There-
fore, , .
1. Be it enacted by the general assembly, That it shall be
lawful for William Smith, by himself or his deputies, to have
the same powers of distress and sale as he possessed before
the said term expired, to enforce the collection of the taxes
due him in said county. The right of distress and sale shall
continue for the term of two years from the first of January,
eighteen hundred and sixty-seven: provided, however, that
‘any person so assessed with taxes remaining unpaid, shall be
entitled to a stay of its collection for twelve months. The
lien for the amount thereof shall be unaffected by such stay.
2. This act shall be in force from its passage.
