Chap. 339.—An ACT relating to the trespass of sheep in Botetourt county
and to provide a penalty therefor.
Approved February 16, 1901.
1. Be it enacted by the general assembly of Virginia, That if any
sheep shall enter into any grounds enclosed by a lawful fence or by a river
or stream, or anv part thereof, which is by law a lawful fence, in the
county of Botetourt, or into any grounds in any magisterial district of
said county, wherein the boundary lines of lots or tracts of land have
heen, or shall hereafter be, constituted lawful fences as to such animals.
the owner or manager of such sheep shall be liable for the actual dam-
ages sustained, and he shall also be liable to a fine of fifteen cents for
each sheep: for every succeeding trespass the owner or manager of such
sheep shall be liable to double damages, both actual and punitive. After
a judgment of the court a lien upon such sheep shall enure for the benefit
of the owner or tenant of such grounds, and execution shall thereupon
issue from the court rendering the judgment, and the sheep so trespass-
ing shall be levied upon by the officer to whom the execution was issued.
who shall sell the same as provided for by statute. Whenever sheep are
found trespassing upon any such grounds the owner or tenant of such
grounds shall have the right to take up such sheep and impound the
same, and the cost of such taking up and impounding shall be estimated
as bs part of the actual damages,
All acts and parts of acts in conflict with this act are herehy
repealed,
3. This act shall be in force from its passage.
