Chap. 322.—An ACT to amend and re-enact section first of the charter of the
Pocahontas light and water company, giving to said company the power
of condemnation and confirming said charter in all other respects.
Approved February 16, 1901.
Whereas the Pocahontas light and water company was duly incorpo-
tated by order of the cirenit court of Tazewell county, Virginia, entered
and recorded as provided by law; and
Whereas it is the desire that said charter be amended and enlarged
so as to give to said company the power of condemnation;
1. Be it enacted by the general assembly of Virginia, That section
“first” of the charter of the Pocahontas Hight and water company be,
and the same is, hereby amended and re-enacted so as to read as follows:
§ 1. That the said R. 8. Brock, G. L. Estabrook, junior, A. C. Den-
niston, C. E. F. Bawley and F. Chalmers, and such other persons as may
hereafter be associated with them, and their successors be, and they are,
hereby incorporated and made a body, politic and corporate, under the
name and style of Pocahontas light and water company, for the purpose
of supplying water, gas light, electric light, clectrie power and ice to the
public in the town of Pocahontas, in the county of ‘Tazewell, state of
Virginia, and to such persons or corporations residing or doing business
therein or adjacent thereto, or in the vicinity thereof as may desire to
use the same, at such price as may be from time to time determinea, and
for that purpose the company may acquire water rights and privileges
and land by purchase, and may acquire by condemnation the right of way
for laying its pipes, mains and conduits, and may secure and store water
and provide, purchase, erect, maintain and operate all works, buildings,
plants, structures, reservoirs, cisterns, pipes and conduits necessary or
convenient to secure and store the same; and may manufacture and pro-
duce illuminating gas and ice and generate electricity for electric light
and power, and provide, purchase, erect, maintain and operate all works,
buildings, plants, structures and machinery necessary or convenient for
the manufacture and production of illuminating gas and ice and the
generation of electricity for electric light and power; and for the purpose
of introducing and supplying such water, gas light, electric light, electric
power and ice to the public in the town of Pocahontas and its neighbor-
hood as aforesaid may erect, construct, and maintain all works, build-
ings, plants, machinery, water pipes and conduits for water, gas mains
and gas pipes, poles, wires and conduits for electrie wires, and other
devices and things necessary or convenient in any way for the reception,
conveyance or distribution of such water, light, power and ice; and may
acquire, purchase, hold, grant, sell, convey, lease or otherwise dispose of and
mortgage all lands, e easements, waters, water courses, water rights, rights,
and privileges i in any way necessary or convenient for the business of the
company; and may lay out and improve said lands, and dispose of the
same in lots or otherwise, and may do any and all things necessary or
convenient for the full and free exercise and enjoyment of the business
of the company; with full power in the company to borrow money and
to create, issue, sell and negotiate its bonds and obligations and secure
the same by mortgage or deed of trust of any part or all of the property
of the company.
2. All other powers, privileges and rights of the Pocahontas light and
water company under its charter aforesaid are hereby confirmed to said
company.
3. This act shall be in force from its passage.
