Chap. 32.—An ACT for the relief of Drs. Robert Glasgow, J. H. Mapp, and
A. D. Estill.

Whereas one Daniel Montgomery, a prisoner charged with a felony,
was duly committed to and confined in the public jail of Rockbridge
county; and
Whereas the said Montgomery while so confined was taken ill with
appendicitis, and while so confined had three attacks of the said disease,
and it became necessary in order to save the life of said prisoner, that
an operation to remove the appendix was made necessary, and surgeons
doctors Robert Glasgow, J. H. Mapp, and A. D. Estill were employed by
the jailer under orders from the judge of the county court to attend said
prisoner and perform said operation, and said surgeons did perform said
operation upon the said Montgomery successfully, and presented their
bill for services to the county court of Rockbridge, which court allowed
the said bill, but the auditor of the commonwealth refused to allow said
bill, claiming that there was no warrant in law for allowing the same;
therefore, .
1. Be it enacted by the general assembly of Virginia, That the board
of supervisors of Rockbridge county be, and they are, hereby authorized
and directed to pay doctors Robert Glasgow, J. H. Mapp and A. D. Estill
the sum of seventy-eight dollars to compensate them for their services
as surgeons in performing an operation for appendicitis upon one Daniel
Montgomery, a prisoner confined in the public jail of Rockbridge county.
2. This act shall be in force from its passage.
