Chap. 211.—An ACT to authorize the Chesapeake and Ohio railway company
to make sale and transfer to the William R. Trigg company of the Rich-
mond dock and so much of its real estate as may be necessary and appurte-
nant to the use thereof, lying and being in the city of Richmond, Virginia,
eee of the eastern face of the masonry of the first lock above the ship-
lock.

1. Be it enacted by the general assembly of Virginia, That the Chesa-
peake and Ohio railway company is hereby authorized to sell and convey
to the William R. Trigg company, its successors and assigns, the Rich-
mond dock and so much of its real estate as may be necessary and appur-
tenant to the use thereof, lying and being in the city of Richmond, Vir-
ginia, east of the eastern face of the masonry of the first lock above the
ship lock, upon such terms as it may deem reasonable and proper, and it
shall be lawful for the William R. Trigg company to purchase and hold
said property upon such terms, and execute a lien or liens upon the prop-
erty so purchased, and its profits and franchises, or any part thereof, to
secure the payment of the purchase money or the payment of any money
which said William R. Trigg company may deem advisable to raise for
the purposes of the company.
2. When said property shall have been so purchased by the William R.
Trigg company, it shall be completely vested in it, and its successors, for-
ever; and the said William R. Trigg company, its successors and assigns,
shall be regarded in law as the successor of the Richmond dock company,
the James river and Kanawha company, and its successors and assigns,
as respects the said Richmond dock, and shall enjoy all the charter rights
and privileges incident and appurtenant thereto, and be subject to all of
the duties imposed upon the said Richmond dock company, its successors
and assigns, by law.
3. It is hereby expressly provided and declared that in addition to the
foregoing the contract of sale and conveyance aforesaid shall, among
other things, contain the following provisions and conditions, and shall
not contain any conditions or provisions inconsistent therewith—viz:
The rate of dockage at Richmond shall not exceed the rates established
by the James river and Kanawha company, and in effect on the twenty-
seventh day of February, eighteen hundred and seventy-nine, said rates
being the maximum limit of power of the Chesapeake and Ohio railway
company in that regard; and it is further declared to be the duty of the
Chesapeake and Ohio railway company, its successors and assigns, to con-
tinue the supply, at or near said eastern face of said masonry of the first
lock above the ship lock, the present quantity of water, which
shall, when so supplied, be taken and deemed to be a full and sufficient
compliance by said Chesapeake and Ohio railway company, successor of
the Richmond and Alleghany railway company, of all the conditions im-
posed by the said act of February twenty-seventh, eighteen hundred and
seventy-nine, as regards the Richmond dock and connection with tide-
water, and thereupon it shall be and is hereby declared to be the duty of
the said William R. Trigg company, its successors and assigns, so to re-
ceive said water supply at the said point and to maintain the water sup-
ply of said docks so as in no manner to lessen said water supply as the
same exists at present; and as a further condition, it shall be provided
in said conveyance that the same shall be made subject to all the rights
and obligations of the Chesapeake and Ohio railway company in respect
to its double track iron or steel viaduct or structure as set forth in that
certain ordinance of the city of Richmond, approved June twelfth, eigh-
teen hundred and ninety-nine; and the said William R. Trigg company
shall become a party to said conveyance for the purpose of expressing its
acceptance on behalf of itself, its successors and assigns, of the duties
and obligations hereinabove set forth by it and then to be assumed and
performed; a copy of said conveyance duly authenticated shall be filed
with the board of publie works of the state of Virginia.
4, This act shall be in force from its passage.
