Chap. 6.—An ACT to amend and re-enact section 82 of chapter 88 of
the Code of Virginia.
Passed February 28, 1866.
1. Be it enacted by the general assembly, That the thirty-
second section of chapter thirty-eight, concerning taxes on
licenses, be amended and re-enacted so as to read as follows
“§ 32. If the merchant shall desire his license to include
permission to sell, by retail, wine, ardent spirits, or a mixture
thereof, he shall pay the additional tax prescribed for this
privilege, and obtain from the court of the county or corpo-
ration in which his store or place of sale is situated, a certificate
that he is a person of good character, and that the court sees
no objection to such permission being granted; but no court
shall grant such certificate, unless it is composed of a majority
of the acting justices of the county or corporation, or unless
the justices “ot the county or corporation shall have been
summoned for such purpose. If such certificate be applied
for and refused. the refusal shall be entered of record; and
afterwards such certificate shall not be granted to the appli-
cant before the next April term, unless by a court composed
of the same Justices to which the first application was made,
or a majority of the acting justices of the county or corpo-
ration, or a court to which the justices of the county or
corporation shall have been summoned for that purpose; and
where the justices are summoned by virtue of this section,
the applicant or applicants shall pay the expense.”
This act shall be in force from its passage.
