Chap. 52.—An ACT to amend and re-enact section 12 of chapter 128 of
the Code of 1860.
Passed February 28, 1866.
1. Be it enacted by the general assembly of Virginia, That
the twelfth section of chapter one hundred and twenty-cight
of the Code of eighteen hundred and sixty be amended and
re-enacted so as to read as follows:
“§12. What may be received under this, or the one hun-
dred and twenty-fourth chapter, for the real estate of an
infant, insane person or married woman, sold or divided, or
so much thereof as may remain at his or her death intestate,
shall, if he or she continue, until death, incapable, from any
cause, of making a will, pass to those who would have been
entitled to the land if it had not been sold or divided.”
2. This act shall be in force from its passage.
