Chap. 48.—An ACT to amend and re-enact the 25th and 27th sections of
chapter 92 of the Code of Virginia, relating to Pilots.
Passed February 10, 1866.
1. Be it enacted by the general assembly, That the twenty-
fifth section of chapter ninety-two of the Code of Virginia
be and the same is hereby amended and re-enacted so as to
read as follows:
“§ 25. The county court of Alexandria county shall ap-
point five persons, two of whom shall be pilots of the Poto-
mac river, to constitute a board of commissioners to examine
ersons applying for branches as pilots for the river Potomac.
The said board, when appointed, shall meet in Alexandria.
Every person applying to said board to be licensed as a
branch pilot, shall satisfy them of his citizenship, and of his
good character, and that he is qualified, by knowledge and
service and experience, to act as a pilot for the Potomac
river. The said board shall take bonds from each pilot, in
the penalty of five hundred dollars, for the faithful discharge
of his duty; which the said board shall return to the clerk
of the county court of Alexandria county, to be by him filed.
The said board shall be allowed a fee of five dollars for each
pilot they license, and they shall decide how many pilots are
necessary. It shall be unlawful for any person, not having a
license as a branch pilot, to undertake the duties of a pilot;
and for so doing, the offender shall forfeit his boat and equip-
ments, and pay to the pilot, who detects and arrests him, the
sum of seventy-five dollars.”
2. And be it further enacted by the general assembly, That
the twenty-seventh section of chapter ninety-two of the Code
of Virginia be and the same is hereby amended and re-enacted
so as to read as follows:
“§ 27. The said pilots are authorized to receive and collect
pilotage at the following rates, to wit: On all vessels drawing
under fifteen fect, inward bound, two dollars per foot; out-
ward bound, one dollar and seventy-five cents per foot; on
all vessels drawing fifteen feet and over, inward bound, two
dollars and fifty cents per foot; outward bound, two dollars
and twenty-five cents per foot; and every vessel spoken by
such a pilot between Point Lookout and Ragged Point, or at
Alexandria, and refusing him, shall pay to said pilot full
protage Any pilot being detained on board any vessel, shall
e entitled to three dollars for each day he may be so de-
tained; to be paid by the master, agent, owner or consignee
of said vessel. If any master of a vessel shall carry such
pilot beyond his state against his will, he shall pay to such
pilot the sum of three hundred dollars. The said pilots shall
appoint an agent or agents for Alexandria, who shall have
power severally to grant licenses to all vessels trading to. the
otomac river, for which licenses such agent shall receive ten
cents per ton for one year. And all vessels having such
licenses shall be free to sail without pilots; but the master of
such vessel, required to take out license, navigating the Po-
tomae river witout such license, shall either take the first
pilot who offers to pilot his vessel, or shall pay him full pilot-
ace; but the payment of full pilotage shall not be exacted
from any inward bound vessel, which, on her arrival and
before her departure, shall obtain trom the agent a license as
above required. All vessels arriving at Pilot Station, between
Point Lookout and Raveed Point, shall remain fifteen hours
after arrival, to give the pilot an opportunity to be taken
out, under a penalty of fifty dollars.”
3. This act shall be in force from its passage.
