Chap. 42.—An ACT to amend and re-enact section 1 of chapter 51 of the
Code of 1S60.

1. Be it enacted by the general assembly, That the first
section of chapter fifty-one of the Code of Virginia of eigh-
teen hundred and sixty shall be amended and re-enacted so
as to read as follows:
“§ 1. Overseers of the poor for each county, without
the limits of a town that provides for its poor, shall be
elected, and vacancies be created and supplied, and the dura-
tion of their term of office, the time for 1ts commencement,
and their qualifications, shall be as prescribed by the seventh
and ei¢hth chapters; and the mode of contesting their elec-
tions shall be according to the provisions of the tenth chap-
ter. In any town, the council thereof may prescribe the
number of overseers of such town, their term of office and
compensation, and the time and manner of appointing them.
Any person elected or appointed overseer, who shall fail to
serve, shall forfeit one hundred dollars, unless he be a person
who, in the course of the next preceding nine years, shall
have served three, or unless he be unable to serve from age
or infirmity. The powers and duties of overseers of the
poor shall be such as were prescribed by the laws in force
when the constitution was adcpted, so far as the same are
consistent with this act, and such as now are or may be here-
after prescribed by law: and for misconduct, or neglect of
duty, they shall be liable to the penalties now prescribed by
law. The fees and allowanees tor overseers of the poor shall
be as now preseribed by law.”
2. This act shall be in force from its passage.
