Chap. 41.—An ACT to repeal the Ist section of the act to repeal and. re-
enact the 2d and Uh sections of the d2d chapter of the Code of 1860,
and to re-enact the said 2d section.
Passed February 28, 1866,
1. Be it enacted by the general assembly, That the first
section of the act entitled an act to amend and re-enact the
second and ninth sections of the forty-second chapter of the
Code of one thousand eight hundred and sixty, passed March
first, eighteen hundred “and sixty-five, be and the same is
hereby repealed, and that the said second section of chapter
forty-two of the Code (edition of eighteen oicenaiaie and
sixty) be re-enacted as follows :
“ 2. The proceeding may be in the circuit eourt of the
city of Richmond. W hen it is at law, it may be by action
or motion.”
2. This act shall be in force from its passage.
