Chap. 347.—-An ACT for the relief of the Estate of William Mitchell,
junior, deceased,
Passed January 13, 1566.
!. Be it enacted by the general assembly, That Samuel
P. Mitchell and Andrew Johnston. executors of William
Mitchell, junior, deeeased, late of the city of Richmond,
Virginia, be and they are hereby authorized, for the purpose
of rebuilding the houses which have been destroyed by fire
nnon the real estate of the said William Mitchell, junior,
deceased, situate in the said city, to borrow money, at any
rate of interest not exceeding eight per centum per annum,
and to secure the same by mortgage or deed of trust upon
the property so to be improved, or to execute leases of the
said property for any term of years, not exceeding ten years,
to any person or persons who will erect buildings upon the
seme: and the said executors shall be and are her eby autho-
rized to adopt either or both of the said methods, asin their
discretion they may deem most advantageous for the parties
interested in the said estate: and any “and all mortgages,
deeds of trust and leases which may be made by the said
executors, in pursuance of the authority hereby conferred
upon them, shall be valid and binding upon all persons who
are now or may be hereafter interested In the said estate,
either in possession, reversion or remainder, and whether
such interest be vested or contingent: provided, however,
that no contract to be made as afuresaid by the said execu-
tors, either for the loan of money or for the leasing of real
estate, shall be valid and effectual until the same shall be ap-
proved by the judge of the circuit court, or by the judge of
the hustings court of the said city of Richmond; which ap-
proval may be given either in term time, or in vacation.
