Chap. 344.—An ACT for the relief of Wulter Powell, late Sheriff of
Fairfax County.
Passed Deesmber 16, 1865.
Whereas Walter Powell, late sheriff of Fairfax county,
whose term of office expired on the first day of January,
eighteen hundred and sixty- one, has been prevented by the
war from collecting the amounts due him, as provided by the
fourth section of chapter thirty-six of the Code of Virginia,
notwithstanding he has advanced and paid the whole revenue
of the county into the treasury of the state: Therefore,
1. Be it enacted by the general assembly, That it shall be
lawful for Walter Powell, by himself or his deputies, to have
the same powers of distress and sale as he possessed before
said term expired, to enforce the collection of the taxes due
him in said county. The right of distress and sale shall con-
tinue for the term of two years from the first of January,
eighteen hundred and sixty-six: provided, however, that any
person so assessed with taxes remaining unpaid shall be en-
titled to a stay of its collection for twelve months. The
lien for the amount thereof shall be unaffected by such stay.
2. This act shall be in force from its passage.
