Chap. 335.—An ACT to amend and re-enact the Ist section of an act
passed 15th December 1865, entitled an act for the relief of Henry
Stephenson of Frederick County.
Passed Febitary 23, 1808.
1. Be it enacted by the general assembly, That the first
section of an act for the relief of Ienry Stephenson of
Frederick county, passed December fifteenth, eighteen hun-
dredand sixty- five, be amended and re-enacted so as to read
as follows:
“§1. Be it enacted by the general assembly, That the
circuit court of the county of Frederick is empowered, on a
bill being filed by the petitioner, Ilenry Stephenson, accom-
panied by a copy of his petition and documents laid before
the general assembly of Virginia, and atter due examination
of the merits of the case, if in its discretion it sees fit, to
decree a sale of one hundred and seventy-four acres of the
four hundred and seventy-four in the petition mentioned, or
so much thereof as the court may deem adequate to effect
the legitimate object of the petition, to be designated by
metes and bounds to be determined by the court, and to
direct the proceeds of the sale to be paid in court; and that
the judge of the said court may, in vacation, appoint three
commissioners, who shall examine and report fully to the
court the state of repairs in which said tract of four hundred
and seventy-four acres was on the first day of January,
eighteen hundred and sixty-six.”
2. This act shall be in force from its passage.
