Chap. 334.—An ACT for the relief of Henry Stephenson of Frederick
County,
Passed December 15, 1805.
lL. Be it enacted by the general assembly, That the circuit
court of the eounty of Frederick 1s empowered, on a bill
being filed by the petitioner, Henry Stephenson, accompanied
by a copy of his petition and documents laid before the gene-
ral assembly of Virginia, and after due examination of the
merits of the case, if in its discretion it sees fit. to decree a
sale of one hundred and seventy-four acres of the four hun-
dred and seventy-four in the petition mentioned, or so much
thereof as the court may deem adequate to effect the legiti-
mate objects of the petition; to be designated by metes and
bounds to be determined by the court, and to direct the pro-
ceeds of the sale to be paid into court.
2. The proceeds of said sale shall be loaned to said Henry
Stephenson, free and clear of interest during his life; and for
such loan, sad Tfenry Stephenson shall execute his bond,
with ample security, payable to the receiver of the court, to
the credit of the cause: the condition of which bond shall
be, that the amount so loaned shall be paid to the said re-
ceiver on theMleath of said Henry Stephenson.
3. The court shall cause what shall remain of the four
hundred and seventy-four acres and buildings after the sale,
to be examined by commissioners, who shall report fully
upon the state of repairs in which they may find them—their
report to be filed in the canse.
4. On the death of said Henry Stephenson, the parties
bound by said bond shall be entitled to a credit against it for
the value of all repairs found on said premises at his death,
and not on them when received by the commissioners; and
the residue of the bond, if any, shall be collected and. paid
over to the parties entitled under the will of the petitioner's
father.
0. This act shall be in force from its passage.
