Chap. 288.—An ACT to legalize the Ferry established by Benjamin Fleet,
at Dunkirk, in King & Queen County, in place of the Toll Bridge at
that place, burnt by the Federal Army.
Pasacd February 28, 1666.
Whereas the toll bridyve across the Mattapony river at Dun-
kirk, in King & Queen county, erected by Archer Brown, by
virtue of anact of the general assembly of Virginia, passed on
the tenth day of January, eighteen hundred and thirty- -one,
was destroyed by the federal army during the late civil war,
and Benjamin 1} reet, deceased, the owner of said bridge at the
time of its dextruction, opened, and he and his executors
have since kept, and still keep a ferry at the same poiut for
the accommodation of the United States mali, and of travel-
lers generally :
1. Be it enacted by the general assembly, That the ferry
so opened by the said Benjamin Fleet, and now kept at Dun-
kirk, in King & Queen county, by his executors, be and the
same is hereby declared to be a lawful ferry, in ‘place of the
hridve so destroved as aforesaid; and the said executors and
their assigns are hereby invested, in their fiduciary character,
with all the mehts. privileges and immunities conferred by
law on the owners and keepers of public terries.
2. It shall he lawil to charge three cents for every person,
every Wheel, every horse, mule or work-ox; one cent for
every head of ¢: ttle: ten cents for every score of sheep, hogs,
goats or Iambs—and so in proportion for a greater or less
number transported across said ferry: provided. that it shall
not be lawful for the owners thereof to ask. demand or re-
ceive more than five dollars tur the annual rent or use of the
suid ferry, under any contract made with any person tor the
passage of his or her family and the transportation of the
produce of his or her farm during any one year: and pro-
vided further. that. the owners of said ferry shall have two
years and six months, from the passave of this act. to rebinld
the bridge for which the said ferry is hereby substituted, for
Which period only this act shall be in force: and that atter
the smd bridge shall be relinit., the provisions of the act
under which the same was originally built, shall apply to the
same.
