Chap. 282.—An ACT authorizing the Trustees of the Town of Manches-
ter to construct a Bridge across James River at Richmond.
Passed January 9, 1863.
Be it enacted by the general assembly, That the trustees
of the town of Manchester, acting for and in behalf of said
town, are hereby authorized to construct a bridge across
James river, from said town to the city of Richmond; and
for that purpose, said trustees are authorized to borrow, on
the credit of said town, a sum not exceeding three hun-
dred thousand dollars, and to pledge the credit “of gaid town
for the redemption thereot: and they are also authorized to
secure the repayment of the same, by a lien on the improve-
ment hereby authorized, and its profits, or on the real pro-
perty of the town, known as the “town common,” with the
water pow er appurtenant. or by hen on both.
2. Said bridee shall be owned as the property of said
town, aul as such, held and managed by said trustees, who
are authorized from time to time to regulate and prescribe
rates of toll: provided, that such rates shall not exceed the
lowest rates allowed, at any time during the year eighteen
hundred and sixty, for passing on or over the bridge at said
city, then known as “ Mayo’s bridge:” and provi ided also, that
said tolls shall be so regulated as not to.raise any amount
more than is sufficient to pay the principal sum, with interest,
expended in constructing, keeping in repair, and managing
said bridge, together with any tund which may be accumu-
lated under this act, and set apart for the purpose of keeping
said bridge in repair, or replacing it, if destroyed.
3. Said trustees, after paying from the tolls the original
cost, with interest, of the construction, the repairs and the
management of said bridge up to any period, may thereafter
continue to charge and collect toils until a net sum, beyond
the accruing expenses, not exceeding two hundred thousand
dollars, is raised, which (being inv ested for the purpose here-
in named only), shall be used in keeping said bridge in repair,
and in replacing it if destroyed. The principal of said fund
shall not be resorted to except when the interest shall from
any cause prove Insuflicient; and when any part of the prin-
cipal find is so used or lost without the default of said
trustees, it may be replaced by tolls.
4, Said trustees may from time to time discontinue the
collection of tolls, and from time to time resume such collec-
tion, as circumstances may authorize, in pursuance of the
other provisions of this act.
o. Said trustees are authorized to let the use of said bridge,
on reasonable terms, to individuals or companies, for fixed
periods, in licu of receiving tolls of such persons or companies
during anich periods.
6. Said trustees, in “their diseretion, may, at any time, and
for any period, exempt toot passengers from the payment of

If any person shall refuse to pay toll, when properly
demanded, he shall forfeit ten dollars ; which, together with
the tolls so due, and costs, shall be recoverable before any
justice of the peace for the county of Chesterfield. Any
sum so recovered shall be applied in the same manner with
tolls: but this provision shall not be deemed to impair the
right of said trustees, or their agents, to refuse passage to
any person or thing on or over said bridge until the lawful
tolls are paid therefor.
8. If any person shall ride or drive on or over said bridge
at any gate faster than a walk, the person so offending shall
forfeit ten dollars; to be recovered with costs, and applied
as in the preceding section provided.
9. Said bridge, with the roads or streets leading thereto
or therefrom, shall not be more than eight feet wide. Said
trustees are authorized to acquire, by contract, the land ne-
cessary for the purpose of said bridge and its proper appur-
tenances, and no more; or they may acquire the same by
condemnation, in pursuance of the provisions of chapter
fifty-six, Code of Virginia (eighteen hundred and sixty), to
be pursued and adopted as far as applicable and consistent
with the provisions of this act.
10. Said trustees may employ a toll gatherer, clerk, and
such other agents as may be necessary in the management of
said bridge, the expense whereof shall be paid out of the tolls
derived trom said bridge.
11. Said trustees, in their proper corporate name and style,
mav sue and be sued in reyard to all matters arising under
this act. as in other cases. /
12. Said trustees, in reference to the provisions of this act,
shall enjoy all the rights and be subject to all the liabilities
conferred or imposed on other corporate bodies by the Code
of Virginia, so far as applicable and consistent.
13. Said trustees shail cause a taithful account to be kept
of all transactions under this act, which shall at all times be
open to the inspection of the board of public works, under
Whose superintendence the provisions of this act: shall be
enforeed.
14. This act shall be im force from its passave, and. shall
be subject to modification or repeal. at the pleasure of the
general assembly,
