Chap. 271.—An ACT in rezard to the Rockingham Turnpike Company.
Pasxed February 16, 1866.
Whereas the Rockingham turnpike company did, on the
thirteenth day of June, in the year eighteen hundred and
fifty-seven, execute a deed of trust upon their road to E. A.
Shands, as trustee, to secure the payment of various debts
due trom said company; under the provisions of which deed,
it appears that the said road’ was sold. in August, ciechtoon
hundred and sixtyys by the sail trustee, and purch: rsed by
Henry Forrer, A. D. Almond and George J. Stephens; and
that said trustee (i. A. Shands) has departed this Hte, with-
out making any conveyance of said road to the purchasers :
1. Be it therefore enacted by the general assembly, That
it shall be lawful for the county court of Rockingham, with-
out notice, upon the motion.of any party interested, to ap-
point a trustee in the place and stead of said EK. A. Shands,
who shall be invested with all the powers and duties which
were vested in the said I. A. Shands, by virtue of said trust
deed, and of any law appheable thereto, with power, upon
the payment or securement of the purchase money, to exe:
cute adeed for said road to the purchasers thereof; which
deed shall have the same effect as if it were executed by said
EK. A. Shands, under the provisions of chapter sixty-one of
the Code of eighteen hundred and sixty.
2. Be it further enacted, That the said Henry Forrer, A.
D. Almond and George J. Stephens be and they are hereby
required to proceed, at once, with the repair of said road, and
the rebuilding of the bridges thereon, so as to place the same
in travelling order ina reasonable time; and for this purpose,
they are invested with all the powers, rights and privileges
which were vested, for that purpose, in the Rockingham
turnpike company by its charter, and subject to all the duties
and liabilities imposed thereon.
3. This act shall be in force from its passage.
