Chap. 238.—An ACT to incorporate the Brush Mountain Mining and
Transportation Company,
Passed February 14, 1566.
1. Be it enacted by the general assembly of Virginia, That
O. D. Thompson, John R. McDaniel, J. J. Irby, Aub. Pierce,
Oliver Pierce, and their associates and successors, or a ma-
jority of them, are hereby created and constituted a body
politic and corporate, by the name and style of The Brush
Mountain Mining and T ransport: ation Company; for the pur-
pose of holding and possessing real estate in the state of
Virginia, not exceeding five thousand acres, and other pro-
perty, for the purpose of mining, transportation and manu-
facturing ; and by that name and style, shall have perpetual
succession; may contract and be contracted with; sue and
be sued, plead and Be impieaded, in all courts and places;
have a common seal, and all the rights and privileges of a
corporation; and be sihject to all the rules, regulations and
restrictions imposed by the Code of Virginia, in relation to
joint stock companies, so far as they are applicable to, and
not inconsistent with the provisions of this act.
2. That the capital stock of said company shall not be less
than fifty thousand dollars nor more than four hundred thou-
sand dollars, to be divided into shares of one hundred dollars
each: and said capital may be increased to the hmit afore-
said, from time to time, by the directors of the said company.
3. That the company shall have authority to make from
time to time such by-laws and regulations as it may deem
necessary or proper ‘for the management of its aftnirs; may
tix the number of its directors, and may hold its meetings in
either the city of Lynchburg or the town of Christiansburg;
and in all general meetings of the company, the stoc kholderg
present, In perscn or by proxy, shall be entitled to one vote
on each share of their stock.
4. The company may construct, with the-consent of the
owners of the lands over which the road shall pass, a rail or
tramroad connecting the Brush mountain, in the county of
Montgomery, with the V irginia and Tennessee railroad, at
any point on the said last mentioned railroad that the said
Brush mountain mining and transportation company may
select; and the said company may extend their rail or tram-
road in the direction of Pearisburg, in Giles county, twenty
miles or less, at their option.
». This act shall take effect from and after its passage.
