Chap. 206.—An ACT incorporating the Stockholders of the Richmond
and Petersburg Railroad Connection Company,
Passed March 3, 1866.
1. Be it enacted by the general assembly of Virginia, That
it shall be lawful for the common council of the city of Pe-
tersburg to cause books of subscrfption to be opened in the
said city, at such time and place as they may think proper,
and under the supervision of such persons as they may ap-
point, for the purpose of receiving subscriptions to an amount’
not exceeding two hundred thousand doll: irs, in shares of one
hundred dollars each. to constitute a joint stock company, to
be entitled The Petersburg Mailway Connection Company ;
with power to construct a railroad through the said city,
connecting with the Richmond and Petersburg and the Pe-
tersburg and Weldon railroads, and to such other places
within the limits of the said city as the proper authorities of
the said Petersburg railway connection company may deter-
mine, by and with the sanction of the council of the said city.
2. Be it further enacted, That the location, manner of
construction and manner of operating the said railroad, shall
be subject to the pleasure and restrictions of the said council
of the said city, and to all the provisions of the general rail-
road law: provided, that tur transporting passengers over the
said connecting road, it shall be lawful to charge a toll of not
more than fifty cents for each passenger over said road, and for
transporting goods, produce, merchandise and other articles
over the said road, an average rate of tolls of not more than
five cents per mile for each hundred pounds so carried over
the said road: provided, that the rates of toll authorized by
this section shall not apply to freight or passengers trans-
ported only between the cities of Richmond and Peter sburg:
and provided further, that whenever the net profits accruing
from transportation over the said connection shall be such
that, but for this section, dividends might be declared out of
the profits, exceeding fitteen per centum per annum on the
capital stock invested, atter payment of all necessary ex-
penses, and after setting apart a fair and reasonable surn for
repairs of said company’s roadway and other structures, then
the said rates of toll shall be reduced by the said company,
so as to enable them to divide fifteen per centum per annum:
provided, that the work authorized by this act shall be com-
menced within one year, and finished within three years from
and after the passage of this act, and that the road shall not
be used for the transportation of freights, passengers, mails
or other things until the completion of a railroad connecting
the Richmond and Petersburg railroad and the Richmond,
Fredericksburg and Potomac railroad: and provided further,
that the work authorized by this act shall not be commenced
until the Richmond and Petersburg railroad company shall
have established its depot at the southern end of its road on
the southern side of the Appomattox river, at such point as
has been or may be designated by the common council of
Petersburg, as provided by the act of eighteen hundred and
thirty-six.
3. Be it further enacted, That the said city of Petersburg
may, in her corporate capacity, subscribe one-half of the
capital stock of such company: provided a majority of the
qualified voters of said city shall authorize such action and
subscription on the part of said council, who are hereby
authorized to take the sense of said voters in the premises.
4. Be it further enacted, That the Petersburg railroad
company and the Richmond and Petersburg railroad company
shall each be authorized to purchase and hold stock in the
company hereby incorporated, not exceeding in amount one-
third of the whole amount of the stock of the said company ;
and that either of the said railroad companies separately, or
both of them jointly, may at any time, not less than eleven
years from the passage of this act, purchase the whole or any
part of the work constructed by authority of this act, at the
valuation thereof: and upon the tender, in legal currency
of the United States, of such valuation to the company char-
tered by this act, all the right, title and franchises of-said
company shall pass to the company or companies so tendering.
o. This act shall be in force from its passage.
