Chap. 202.—Au ACT to incorporate the Norftoik City Ridlroad Company,
Passed January $, 1s65,
1. Beit enacted by the general assembly, That Thomas J.
Corprew, John Bo Whitehead. W.W. Wi Ing, Mdmund C.
liobinson, Cicero Burness and William IT. C. Ellis, toeether
with their associates, successors and assigns, are hereby
ereated a body politic and corporate, under the name and
style of The Noriolk City Railroad Company; and as such,
shall be subject to all the provisions of the Code of Virginia
applicable to corporations, except as hereimatter provided.
2. That it shall be lawful tor said company to lay out, con-
struct and equip, maintain and operate, with horse or mule
power, a single or double track ruiroad im the city of Nor-
felk, throughout the entire Jeneth of Main street. down
Market square to the Ferry wharf: up Church street to the
Fair grounds in Norfolk county; and also through such other
streets or parts of streets in said city as the directors may
determine; and also to such other points in Nortolk county,
not exceeding six miles, as said directors may determine
upon: provided, that before such work shall be commenced,
the consent of the council of said city shall be obtamed
thereto.
d That said company shall Keep that portion of the street
occupied by its track or its tracks, embracing the space be-
tween said tracks and a distance of at least two feet beyond
the outer rails thereof, well paved and in’ good repair, with-
out expense to the cerporation of the city of Norfolk: and
the rails used for said tracks shall be of the most approved
pattern for such purposes; and shall be laid at the distance
of five feet five inches between the outer ridges or flanges
thereof, and upon an even suriace with the adjoining pave-
ment, so as to form as little obstruction as practicable to the
passe of carriages or other vehicles along or over said
racks,
That it shall be lawful for said company to transport
passengers, light freights and bavyvave over said road or roads
hereby authorized to be constructed, and to collect: fare and
tolls for the same, not exceeding the sum of ten cents tor
passage to and from any point within the Itmits of the city.
and the Jike sum for packages and bundles oceupying the
space of a passenger, within the said Hmits; and the sum of
fiiteen cents for the same passage and freight to and trom
any point within the said city, to and from any point beyond
the limits thereof. ‘The number of directors in said company
shall net exceed nine, the president included.
® That it shail be lawtul for said company to create and
issue its capital stock to an amount not exceeding one hun-
dred thousand dollars, in shares of fifty dollars each, and also
to borrow money upon its bonds, secured by mortgage or
decd of trust upon its property and tranchises, to an amount
not exceeding the amount of its capital stock, subseribed,
paid in and expended in the construction and equipment of
its road, and for other purposes legitimately appertaining
thereto.
6. That said company shall have at all times free and undis-
‘tturbed use of their railway and other property ; and if any
erson or persons shall wilfully or unnecessarily obstruct or
Impede the passage of cars on or over any portion of said
road, or shall injure or destroy the cars, depots, or any other
property belonging to said company, the person or persons
so offending shall forfeit and pay to said company, for every
such offence, the sum of five dollars; and shall remain liable,
in addition to said penalty, for any loss or damage occasioned
by his, her or their act as aforesaid.
t. That it shall be lawful for said company, for the purpose
of constructing and equipping and operating said railway, to
sell their bonds, with coupons attached, at a rate of interest
not exceeding eight per centum per annum, to be paid semi-
annually, to the amount of fifty thousand dollars, and also to
borrow, upon their promissory notes duly executed under
the authority of board of directors, to an amount not exceed-
ing fifty thousand dollars, and to lease their road to any per-
son or persons, or domestic or foreign corporation: any of
which corporations shall have power to subscribe to the stock
of said company.
8. This act shall be in force from its passage, and shall be
subject to amendment, modification or repeal, at the pleasure
of the general assembly.
