Chap. 171.—An ACT to authorize the Circuit Court of Halifax County to
rehear the Case of Spragins vs. Spragins.

Whereas it is represented to the general assembly, that a
suit is now depending in the chancery side of the circuit
court for the county of Halifax, in which Rebecca A. Sprag-
ins is plaintiff, and Leonidas D. Spragins (the husband of' said
Rebecca) is defendant, in which said plaintiff alleged cruelty
and adultery against the said defendant, and prayed a divorce
from the bonds of matrimony; and that at May term,
eighteen hundred and sixty, a decree was rendered in the
said cause, granting a perpetual separation between the par-
ties, and a divorce from bed and board: and whereas it is
further represented that the said defendant has removed
from this commonwealth; that there is no prospect of a re-
conciliation between the parties, and that the plaintiff is
desirous of having the cause reheard, with a view to apply
to the court for a divorce from the bonds of matrimony; and
that it is doubtful whether there can be such rehearing, as the
law now stands: and whereas it is further represented that
the case is distinguished by acts of cruelty, crimes of adul-
tery and abandonment, on the part of the husband, of
unparalleled enormity : Therefore,
1. Be it enacted by the general assembly, That it shall be
lawful for the said circuit court of Halifax county. to rehear
the said cause, upon the evidence already filed, and such
other evidence as either party shall produce, and to set aside
the former decree, and to grant the said Rebecca A. Spragins
a divorce from the bonds of matrimony, if it shall appear to
the said court that the defendant was guilty of cruel, harsh
treatment and adultery, notwithstanding the said plaintiff
may have cohabited with the defendant after the knowledge
of the adultery; and to grant such other relief as may be
proper.
2. This act shall be in force from its passave.
