Chap. 159.—An ACT to incorporate the Town of Jeffersonville, in the
County of Tazewell.
Passed February 21, 1866.
1. Be it enacted by the general assembly, That the town
of Jeffersonville, in the county of Tazewell, as the same has
heretofore: been laid off (and established by an act of the
general assembly, passed on the eighteenth day of March,
eighteen hundred and fifty, entitled an act to revive and
amend the act entitled an act to prescribe the mode of elect-
ing trustees for the town of Pearisburg, in the county of
Giles, and vesting them with corporate powers, and for other
purposes, and an act, passed subsequent thereto, amendatory
thereof) into lots, streets and alleys, shall be and the same is
hereby made a town corporate, by the name of Jefferson-
ville; and by that name, shall have and exercise the powers
conferred upon towns by, and be subject to the provisions of
the fifty-fourth chapter of the Code of Virginia, so far as
they may be consistent with this act.
2. The officers of said town shall consist of a mayor, five
councilmen, a recorder and sergeant, who shall be elected by
those qualified to vote for members of the general assembly,
and no other persons. - ,
3. The said election shall be held at the courthouse, in said
town, on the first Monday in April annually; and the mayor,
recorder, councilmen and sergeant shall continue in office
until the first Monday in April in each succeeding year, and
until others shall be elected and qualified in their stead, and
no longer.
4, The council shall prescribe the manner of declaring and
certifying elections, of deciding between two or more when
the number of votes shall be equal, and of filling vacancies
in said board. <A majority of said council shall constitute a
quorum to do business.
5. The sergeant of said town, who shall from time to time
be elected under this act, shall have the like rights of distress
and power in collecting the taxes and levies made by the
council of said town, as sheriffs in similar cases, and shall be
entitled to the same or like fees and commissions for collect-
ing said taxes and levies, as are allowed to sheriffs for the
collection of county levies; and in the service and returns of
all process, and in the collection of all fines arising under the
authority of this act, or of any by-laws made in pursuance
hereof, he shall have and possess the same rights and powers,

and be entitled to the sume or like fees and commissions as are
allowed by law to sheritfs for similar services.
6. The sergeant of said town, upon entering into bond
with the county court of Tazew ell county, with conditions
such as constables are required by law to enter into, shall
have power and authority to execute any and all process to
him direeted; and shall and may do and perform all acts and
execute and return such warrants. and be liable in the same
manner, and to the same extent that constables are liable to
by the laws now in force.
7. The mayor, reeorder and councilmen shall and may
exercise all jurisdiction of a justice of the peace, in order to
preserve the peace and good order in said town; and to this
end, they and each of ‘them shall he a conservator of the
peace, with all the powers and duties authorized to be exer-
cised by such conservator, by chapter two hundred and one
of the Code of Virginia. |
8. The mayor, recorder and counchmen, upon taking the
oaths required by Jaw, shall each have authority and juris-
diction to hear and determine all matters in controversy
arising under the laws and ordinances of said town, and: to
issue any and all proper process, whether mesne or final,
which may be necessary to enforce their authority.
9, The council of said town shall be and is hereby invested
with all the powers, rights, liberties and prerogatiy es in rela-
tion to the poor of’ said town, as are contained in chapter
fitty-one of the Code of Virginia; and the said town shall be
entitled to all the immunities, exemptions and privileges
appertaining to any town that maintains and keeps its own
poor, according to the laws now in force in said Code of
Virginia.
10. The said council shall have power andl authority, when-
ever they deem it expedient. to have the sidewalks and gut-
ters along any street within the said town, of such w idth as
they may ; prescribe, pr operly paved, or otherwise suitably im-
proved and repaired and altered. at the proper costs and
expenses of the owners and occupiers of the land or lots
along the tront or sides of which such sidewalks or other im-
provements extend, and to levy and collect a special tax
sufficient for that. purpose, on each of such lots or pieces of
land; which special tax shall be*colleeted by the sergeant. of
said town, as other taxes on real estate within said town are
directed to be collected.
11. All taxes, general or special assessed wpon lands or
lots within the said town under this act, are hereby declared
to constitute a lien upon such Jand or lots, in the hands of
the owner, or his heirs, devisees, assignees, or any subsequent
purchaser or other persons cluming the same, and may be
collected from such subsequent purchaser or other persons en-
titled to such land or lot, in like manner as they might have
been collected trom the original owner or occupier.
12. The council may prevent hogs, dogs and other animals
from running at large within the corporate limits, and may
subject the same to such reculations and taxes as it may deem
proper.
13. The council of said town shall have power to impose
fines, not exeeding ten dollars in amount, tor breaches of the
peace committed in said town; also, tur obstructing the
streets and sidewalks, or for any wiltt] or malicious injury
done thereto, as may be regulated by ordinance of said coun-
cil, and commit to the jail of "Tazewell county till said fines
are paid.
14. For the purpose of carrying into efiect the police regu-
lations of said town, the town shall be allowed the use of the
county jail of Tazewell county, for the sate- -keeping and con-
finemenit of all persons who shall be sentenced to imprison-
ment under the ordinances of said town; and all persons so
contined shall be under the charge and custody of the sheriff
of said county, who shall receive, keep and discharge the
same, in such manner as shall be prescribed by the or dinances
of said town, or otherwisé discharged by due course of’ law.
* 15. All acts and parts of acts, in reference to the said
town ot Jeffersonville, heretofore enacted, inconsistent with
this act. are hereby repealed.
16. William O, Yost, J. E. Chapman, F. M. Pury, George
Spotts and John I. Anderson are hereby author ized to hold
an election, agreeably to the provisions of this act, for said
officers, on the first Monday in April next, at the courthouse
of Tazewell county, in said town.
