Chap. 111.—An ACT to provide for the Reeruiting of the Public Guard,
Parscd January 20, 1865.
1. Be it enacted by the general assembly, That the gov-
ernor be and he is hereby authorized to cause the public
guard to be recruited, upon the basis provided in the first
section of chapter thirty-three of the Code of eighteen hun-
dred and sixty.
2. The said public guard, when it is recruited, shall be
governed by the laws in relation to said guard, in chapter
thirty-three of the Code of cighteen hundred and sixty, and
the act passed April first, eighteen hundred and sixty-one,
entitled an act to increase the pay of certain officers of’ the
public guard, except as the same may be modified or changed
by this act.
38. The governor is hereby authorized to procure suitable
arms, ammunition and equipments for the said public guard;
the cost of which shall be paid tor upon his order upon the
public treasury, out of any money therein not otherwise
appropriated.
4. Under jis direction, quarters shall be provided for the
officers of the guard, or they shall receive commutation in
lieu thereof; and quarters shall also be provided for the non-
commissioned officers, musicians and privates.
9. And be it further enacted, That the joint resolution
passed on the fifteenth day of December, eighteen hundred
and sixty-five, entitled an act to provide for a temporary or-
ganization of the public guard, be and is hereby repealed;
and that the auditor of public accounts do pay out of any
money in the treasury, not otherwise appropriated, to the
officers and men the pay allowed them in said resolution.
This act shall be in force from its passage.
