Chap. 101.—An ACT amending section 46. chapter &> of the Code, con-
cerning Expenses of Conveying Lunaties, &e,
Passed Janvary 16, 1896,
1. Be it enacted by the general assembly, That the forty-
sixth section of chapter eighty-five of the Code of Virginia
be amended and re-enacted so as to read as tolloves:
“§ 46. ach oflicer shall be allowed eight cents per mile,
besides tolls and ferringes, for imsclt, and the same for each
euard, both going and returning from the asylum to carry a
lunatic, and the same sum for the lunatic going, and also return-
ing, when he is carried trom an asylum. but no ofticer shall
be allowed for more than one person as a gnard for one luna-
tic, Without a warrant from the examining justices, authorizing
more than one, nor then tor more than two persons. If, in
any case, the charges allowed by this section shall not be suf-
ficient to defray the actual expenses necessarily incurred in
the performance of the service, the circuit court of the county
or corporation to which the ofheer belongs may, upon proof
of that fact. allow a sum sufticient to cover such deficiency ;
which shall be paid in like manner as the legal charges.”
2. This act shall be in force from its passage.
