Chap. 73.—An ACT incorporating the Berkley and Currituck turnpike
company.
Approved February 3, 1888.
1. Be it enacted by the general assembly of Virginia, That
Parke L. Poindexter, George N. Halstead, B. F. Gibson, E
M. Tilley, Howard N. Johnson, E. B. Freeman, Albert H-
Martin, T. W. Butt, W. N. Portlock, J. N. Eason, G. E. Bow-
den, Charles Gee, Thomas M. Hodgis, Morgan Treat, G. A.
Martin, S. H. McNeil, J. E. Wickins, and J. B. Webb, be and
are hereby made a body corporate and politic under the
name and style of the Berkley and Currituck turnpike com-
pany, with full and adequate powers to construct a turnpike
road from some point at or near the village of Berkley to the
Southern branch road, and along said road to a convenient
point of departure; thence in a southerly direction to some
point near Oak Grove church; thence in a southerly direc-
tion to the county of Currituck, on the North Carolina line:
provided, that the said turnpike road shall not be less than
thirty nor more than sixty feet wide.
2. The said company shall have the privilege in making
said road or any part thereof, to use shell, plank, sand, or any
other material, and shall be privileged to provide open. ditches
on either side of said road.
3. The said company, in constructing or extending said
road or turnpike, shall have the right, with the consent cf
the court of the county in which the road lies, to use the bed
of any public road, and shall have the control of the entire
width of said road so far as they may extend the said turn-
pike along the line of the same; and the said company shall
have power to condemn and use by compliance with the
general laws in such cases, the private lands of individuals
when it is necessary to obtain the proper grade or location of
the road-bed or gates.
4, The said company is hereby authorized to build lateral
or branch roads in any direction not exceeding fifteen miles
each, with the same privileges as conferred in preceeding sec-
tions.
5. The said company is hereby authorized to build and
maintain one or more bridges across the Southern branch of
the Elizabeth river with suitable draw or draws; and the
said company shall be subject to the provisions of the general
laws of the commonwealth applicable to such a corporation.
6. The said company shall be and is hereby authorized to
erect one or more gates across said road at such points as
they may deem expedient, and to charge toll as the board of
directors may order, which may be done after three or more
miles of said road has been completed: provided, that the
rate of said road does not exceed the lawful rates; and on
the bridges those now charged over the Western branch
draw-bridge.
7. The capital stock of said company shall not BE less than

five thousand dollars nor more than one hundred thousand
dollars, to be .divided into shares of fifty dollars each; and
books of subscription shall be opened by Parker L. Poindex-
ter, E. B. Freeman, and E. M. Tilley, three of the corpora-
tors, or such other persons as they may appoint, at such time
and place as they may select for the purpose of receiving sub-
scriptions to the capital stock; and when the minimum stock
is subscribed and two dollars per share paid thereon, the said
corporators may proceed to organize the company as is pro-
vided by law.
8. The said company is hereby authorized to acquire such
jand by donation or otherwise as may be necessary for the
business of the company, and to convey and dispose of the
same.
9. The said company may erect one or more piers on the
Eastern or Southern branches of the Elizabeth river, and col-
lect wharfage for any thing passing over the same.
10. This company shall have the right to acquire an inter-
est in or consolidate with any other turnpike or draw-bridge
company in this state, and said companies shall have the
same privileges with regard to this company.
11. All acts or parts of acts inconsistent with this act are
hereby repealed.
12. This act shall be in force from its passage.
