Chap. 65.—An ACT to incorporate the Wytheville Street railway
company.
Approved February 3, 1888.
1. Be it enacted by the general assembly of Virginia, That
D. S. Pierce, H. Z. Wadley, J. C. Green, 8. R. Sayers, Samuel
W. Williams, James Auman, A. G. Cecil, and Charles KE.
Ewald and their associates and successors, be and they are
hereby constituted a body corporate under the name and
style of the Wytheville Street railway company.
2. Be it further enacted, That said corporation by said
name shall have continuous succession, and in that name may
sue and be sued, plead and be impleaded unto in any court of
law and equity in this state or elsewhere, where their rights
may come in question; may have and use a common seal, and
the same use, renew, and destroy at pleasure; and may
make, alter, and repeal such by-laws governing its own mem-
bers, officers, attorneys, agents, employees, and persons deal-
ing or having business with it as it considerg proper and as
are not in conflict with the general laws of this state. And
said corporation may acquire, purchase, accept, hold, enjoy,
and conve roperty, real or personal,.or,mixed that ma

be necessary or profitable for the purposes of its incorpora-
tion, or which it may acquire in the progress of its business.
It shall have power to fix its rates of toll for the transporta-
tion of persons and property, and collect the same, and in
eneral shall have all such powers, privileges, rights, and
Eanalises as may’ be necessary to successfully accomplish and
carry on the purposes of its incorporation.
3. The said company shall have power and anthority to:
construct, equip, maintain, and operate a street railway along |
the streets of the town of Wytheville, with the consent of
the council of said town, and to any point in the county of
Wythe, with the consent of the county court thereof.
4. It shall be lawful for the said company to transport pas-
sengers, freights, and baggage over their line of railway, and
to collect fare and tolls for the same, and may use horse, mule,
or electric power to propel its cars.
5. Be it further enacted, That the corporate powers of said
company shall be vested in and exercised by a board of direc-
tors consisting of seven stockholders, one of whom shall be
president of the company, and by such other officers and
agents as the board may appoint.
6. The capital stock of said company shall not be less than
one thousand dollars nor more than fifty thousand dollars, to
be divided into shares of twenty-five dollars each, and as soon
as the minimum is subscribed, the company may organize and
shall be authorized to proceed to the construction of said rail-
way. All taxes shall be paid in money and not in coupons.
7. This act shall be in force from its passage.
