Chap. 449.—An ACT for the relief of the sureties of H. R. Burger, late
treasurer of Botetourt county.
Approved March 5, 1888.
Whereas H. R. Burger, late treasurer of Botetourt, has de-
faulted in the payment into the state treasury of money col-
lected by him, and the said Burger has left the state without
making settlement of his accounts with the auditor, but claim-
ing that he is entitled to large credits on the amount now
claimed to be due by him, and his papers are in such condi-
tion that it is believed the said sureties will not be able to
get full credit for the amevats so claimed to have been paid;

and whereas the said sureties had no notice of the defalcation
of said treasurer until after the said Burger had disposed of
his property in Botetourt, and the whole Toss falls upon said
sureties; therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts be and he is hereby authorized
to receive from the sureties of H. R. Burger, late treasurer of
Botetourt county, the bonds of the commonwealth of Vir-
ginia, issued in pursuance of the act of February fourteenth,
eighteen hundred and eighty-two, commonly known as the
Riddleberger bill, in payment of the balances that are due to
the state, and credit said amounts with the face valie of said
bonds: provided, that said bonds shall be paid in within one
year from the passage of this act.
3. The board of supervisors of Botetourt county are author-
ized and empowered to re-open and settle the accounts of
Henry R. Burger, with the county during the time he was
treasurer of said county, upon the petition of his sureties, and
to allow him all proper credits for payment and tor commis-
sions and salaries that they may deem proper and right, and
correct any errors in said accounts for or against said Burger.
3. This act shall be in force from and after May first, eigh-
teen hundred and eighty-eight.
