Chap. 432.—J OINT RESOLUTION relative to defining the line separa-
ting Virginia from West Virginia.
Approved March 6, 1888.
Whereas the general assembly passed certain joint resolu-
tions, approved the first day of April, eighteen hundred and
seventy-three, for the appointment of commissioners to act
jointly with commissioners appointed by the state of West
Virginia tor the purpose of ascertaining and defining the
boundary line between the states of Virginia and West Vir-
ginia; and whereas the said commissioners failed to complete
their work; and whereas it is important that the said boun-
dary line should be established; therefore, :
1. Be it resolved by the general assembly of Virginia, That
James B. Russell, John A. Carson, and A. J. Grayson, be and
are hereby appointed commissioners on the part of this state
to act jointly with commissioners to be appointed by the state
of West Virginia, whose duty shall be to ascertain and locate
the true boundary line between the said states; and any
vacancy occurring in the commission on the part of this state,
may be filled by the governor of Virginia.
2. That the commissioners appointed under these resolu-
tions shall have power to apply through the governor to the
proper authorities of the United States for the detail of one
or more engineers, or to select in connection with the com-
missioners to be appointed by West Virginia, one or more
competent surveyors or engineers to aid in ascertaining and
locating the said boundary line.
3. That the governor of Virginia be requested to furnish a
copy of these resolutions to the governor of West of Virginia,
and to request the state of West Virginia to appoint commis-
sioners to act with those appointed by Virginia.
4. That the commissioners so appointed, shall submit to the
general assembly of this state, immediately after the comple-
tion of their labors, or so soon thereafter as possible, a full
and accurate report of their acts and findings for ratification
or rejection.
5. That the auditor of public accounts be instructed to pay
out of any money in the treasury not otherwise appropriated,
on the order of the governor, an amount not exceeding fifteen
hundred dollars in order to carry out the purposes of these
resolutions, but one-half of the same shall be retained until
the report of the commissioners as above provided for, shall
be made.
6. These joint resolutions shall be in force from and after
the date that a similar commission as that hereby provided
for, shall be created by the state of West Virginia.
