Chap. 387.—An ACT to authorize Princess Anne county to vote on the
question of issuing bonds to build a road, and on the question
whether such road shall be a free or toll road, and to provide for
locating and constructing said road.
Approved March 2, 1888.
1. Be it enacted by the general assembly, That the judge
of the county court of Princess Anne county, be and he is
hereby authorized and directed to appoint three commission-
ers, one Of whom shall be the county surveyor, to locate a
road from Pungo Ridge in said county by the courthouse, to
such point upon Broad creek, between said county and Nor-
folk county, as may be most suitable, expedient, and appro-
priate, all things considered, for crossing said creek by said
road. And said commissioners are authorized to further con-
tinue the location of said road from such point of crossing,
through the county of Norfolk to the city of Norfolk. Said
commissioners shall makesuch surveys and plats as may be ne-
cessary to ascertain the route or location which will best pa
mote the interests of the county of Princess Anne, and shall
report to said court; and the court may hear testimony, and
decide in favor of any of the routes so surveyed, or against
all of them, and may, if it deem best; appoint new com-
missioners and order new surveys. Suitable branch roads
within the county of Princess Anne, running into the main
road, shall also be located by the said commissioners. So
800n as the location of said road and branches shall be
finally decided upon, the county court of said county shall
order an election to be held at the regular polling places in
said county, not less than thirty nor more than thirty-five
days thereafter, at which election the qualified voters of the
county may vote upon the question of issuing bonds, the pro-
ceeds of which shall be used for the construction of the afore-
said road and branches, including the bridge by which said
road will cross Broad creek, and upon the question whether
such road, if constructed, shall be a free or toll road. The
ballots used at such election shall have written or printed
upon them, “for bonds,” for those favoring the construction
of the road, and “against bonds,” for those opposed to its con-
struction; and the same ballots shall have written or printed
upon them, “free road,” for those favoring a free road, and
“toll road,” for those favoring a toll road; and each ballot
shall be endorsed with the name of the voter, which shall be
inspected by the judges of election at the time of voting.
The, election to be held under this act, shall be governed by
the general election laws of this state, except as herein other-
wise provided, and the expenses thereof shall be paid by the
‘county of Princess Anne. So soon as said election shall be
ordered, the board of supervisors of said county shall pro-
vide poll books, and make all preparation for holding the
same. The result of said election shall be certified to the
county court, and if it appears that three-fifths of the quali-
fied voters of the county voting upon the question, are in fa-
vor of issuing bonds, and that said three-fifths includes a ma-
jority of the votes cast by freeholders at such election, and a
majority of the whole vote of the county, measured by the
vote of the last election for governor, then the board of super-
visors of Princess Anne county shall proceed to issue bonds
of the county, registered or coupon, to the amount of fifty
thousand dollars, the same to mature in twenty-five years,
bearing interest at a rate not exceeding six per centum per
annum, payable semi-annually, said bonds or the proceeds
thereof to be used in constructing the road and bridge and
branch roads aforesaid. The board of supervisors of said
county, with the approval of the county court, are author-
ized to contract, in the name of the county, with any re-
sponsible person or persons for the construction of said road,
or any part thereof, and said bridge. And said contract shall
designate the portion or portions of said road which shall first
be built, and shall prescribe the character of said road as to
width, grade, surfacing material, and so forth, and shall pre-
scribe the mode and times of payment for the work, all other
matters needful to protect the interests of the county. And
the person or persons so contracting, shall, before such con-
tract takes effect, be required to give bond with security, to
be approved by said court, in a penalty double the amount
to be paid to him or them under said contract, conditioned
for the due and faithful performance of his or their part of
said contract. The board of supervisors shall levy a tax to
pay the interest on said bonds as it periodically falls due, and
shall make due provision for paying the principal of said
bonds as they mature. If it appears from the certificate
made to the county court of the result of said election, that
a majority of the votes cast, including a majority of the free-
holders voting, is in favor of a toll road, then the board of
supervisors shall so adjist the tollas to provide a fund for the
maintenance of said road and bridge. Due notice of said
election shall be given by public notice throughout the county,

and by publication ten days in one or more newspapers in
the city of Norfolk.
2. All acts and parts of acts in conflict with this act, are
hereby repealed.
3. This act shall be in force from its passage. (
