Chap. 17.—An ACT to provide for the payment of expenses of the
circuit court for Frederick county.
Approved January 18, 1888.
1. Be it enacted by the general assembly of Virginia, That
the expenses and charges of the circuit court of Frederick
county as are not by law payable out of the treasury of the
state, and which heretofore have been paid exclusively out
of the levy of the county of Frederick, shall hereafter be
paid by the city of Winchester and county of Frederick
jointly, in the proportion of one-third by the city of Win-
chester and two-thirds by the county of Frederick.
2. It shall be the duty of the board of supervisors of the
said county and the council of the said city, to make provis-
ion for the payment of their respective proportions of the ex-
penses of the said court as aforesaid; and if either the county
of Frederick or the city of Winchester shall neglect or refuse
to pay its proper proportion as herein provided, mandamus
will lie at the suit of either the board of supervisors afore-
said or the said council, as the case may be, or at the suit of
any party who shows a legal interest therein to enforce the
provisions of this act.
3. This act shall be in force from its passage.
