Chap. 154.—An ACT to authorize the board of supervisors of Buck-
uigham, Prince George, and Surry counties, to let to contract the
public roads, and levy a tax to keep the same in order.
Approved February 18, 1888.
1. Be it enacted by the general assembly of Virginia, That |
it shall be the duty of the board of supervisors of the coun- '
ties of Buckingham, Prince George, and Surry, to take charge
of and have kept in order the public roads and bridges in
said counties, and in order thereto, they shall, as soon as
practicable after this act shall take effect, proceed to lay off '
all the public roads in each magisterial district, designating
them as between given points, in order of their importance
to the public, to-wit: as road number one in district,
commencing at and leading to , and so forth.
2. The said board of supervisors shall annually levy a tax

not exceeding ten cents on the hundred dollars, on all the
taxable values in said counties upon which state taxes are
levied, for the purpose of keeping in order the public roads
in the said counties, and the fund arising trom such tax shall
be set apart and held for that purpose and no other, and shall
be appropriated and paid out under the order of the said
board. All taxes so levied and collected for road purposes,
shall be distributed ratably among the several magisterial
districts. And should said tax prove insufficient, upon
recommendation of said board to the county court, and with
the approval of said court, said road levy may be increased.
3. It shall be the duty of the said board of supervisors to
let to contract, at the lowest bid, all the road districts in the
counties during the month of May foreach year, the contract
year to be from the first of June to the thirty-first of May,
inclusive. After advertising by hand-bills, to be posted in at
least five conspicuous places, in different portions of the
magisterial district, the time and place of letting, coupled
with a designation of the road or roads to be let. But the
contracts to be awarded under this act, shall be separate for
each magisterial district.
4. The board of supervisors shall, after proper notice of
the time and place, proceed, during the month of May, to let
to contract, at the lowest bid, all the roads of the counties to
be kept in order according to law, but no contractor shall be
required to widen the present road-bed, or remove any solid
rock by blasting, or in any way change the location of the
road-bed, unless the same be set out in the specifications and
embraced in the contract. Each contractor shall execute
bond before the county court, with security, to be approved
by said court in double the amount of his contract, payable
to the board of supervisors, for the use of the county, and
conditioned for the faithful execution of the same, which
bonds shall be returned and filed in the county court clerk’s
office for safe-keeping.
5. Should the board of supervisors be unable to let to con-
tract any road or roads on satisfactory terms, they may have
the same worked by the day, week, or month, payable out
of the road levy of the districts respectively in which any
such road or roads may be situated.
6. If great and unforeseen damages shall casually occur to
any road district, the board of supervisors shall have the
same repaired and paid for out of the road fund in such
manner as they think best and the least expensive.
7. All contractors under this act, who shall fail to keep
their roads in order according to law, shall be liable to pun-
ishment and fine, as overseers of roads now are, and all fines
which may be collected of such eontractors and overseers,
shall be paid into the county road fund. No appropriation
by the county court for roads or bridges in excess of thirty
dollars, shall be binding on the counties or paid, unless and
until the same shall have been submitted to and approved by
the board of supervisors.

8. After the completion of the work under every contract, ‘
it shall be the duty of the contractor to notify the supervisor |
of the district in which the work was performed, and as soon
after being notified as practicable, said supervisor shall
examine the road, and upon his report in writing to the board
of supervisors that the contractor has performed the work
according to specifications and contract, the board shall issue
to the contractor entitled to the same, a warrant for the sum
agreed upon for the performance of the work.
9. The clerk of the county court, who is ex-officio clerk of
the board of supervisors, shall, in a separate book for the
purpose, keep a record of all of the road proceedings of the
board under this act. :
10. The members of the board of supervisors shall each |
receive the sum of thirty dollars for the additional duties
imposed upon them by this act.
11. All acts and parts of acts in conflict with this act are
hereby repealed.
12. This act shall be in force from its passage. }
