Chap. 128.—An ACT to amend an act entitled an act to legalize certain
subscriptions of the town of Goodson, Virginia, to the South Atlan-
tic and Ohio railroad company upon certain conditions, approved
May 24, 1887.
vote was within thirty-three of the total number of regis-
tered voters in the town; that the total number of free-
holders voting for the subscription was forty-seven, and the
total number of non-freeholders voting for the subscription
was one hundred and eighty-four; and whereas it is claimed
that the amount of said subscription was in excess of the
amount which the said town was authorized by law to sub-
scribe to any work of internal improvement: therefore,
1. Be it enacted by the general assembly of Virginia, That
an act entitled an act to legalize certain subscriptions of the
town of Goodson to the South Atlantic and Ohio railroad
company upon certain conditions, approved May twenty-
fourth, eighteen hundred and eighty-seven, be amended and
re-enacted so as to read as follows:
§1. Be it enacted by the general assembly of Virginia, That
the said subscription is hereby legalized, ratified, and con-
firmed, and the town council of Goodson, Virginia, is hereby
authorized and it is made its duty to issue and to deliver to
said railroad company, bonds of the corporation having
thirty years to run, and bearing six per centum interest, pay-
able semi-annually, whenever the said railroad shall have
complied with the conditions upon which the subscription
was voted; and the said council is hereby authorized, and it
is made its duty to levy a tax each year upon the taxable
property within its corporation limits sufficient to meet the
interest upon said bonds, and to provide a sinking fund of
one per centum upon the principal of said bonds: provided
that none of the provisions of this act shall become in force
until the said railroad company shall have subscribed an
amount equal to the face value of said bonds, namely: twenty-
five thousand dollars to the capital stock of a company, which
shall have erected a blast furnace of not less than fifty tons
daily capacity, and have the same in operation: and provided
, further, that the said bonds shall not be delivered to the said
railroad company until the said furnace is erected and in
operation upon the line of the said railroad within the cor-
poration limits of. the town of Goodson, or within the county
of Washington, not more than one mile from the corporation
line of said town, and the said railroad company is hereby
authorized to make the said subscription. Upon presenta-
tion to the council of said town of a statement, certified to
by the secretary of the said furnace company, that the sub-
scription of twenty-five thousand dollars has been made by
. the said railroad company, and upon the fulfilment of all the
conditions hereinbefore recited, the said bonds shall be deliv-
ered to the said railroad company, and simultaneously there-
with, the said railroad company shall deliver to the council of
the said town, twenty-five thousand dollars par value in the
capital stock of said railroad company.
2. This act shall be in force from its passage.
