Chap. 10.—An ACT to incorporate the Confederate Soldiers and
Sailors Monument Association.
Approved January 12, 1888.
Whereas it appears to the General Assembly that an organ-
ization known as the Cenfederate Soldiers’ and Sailors’ Mon-
ument Association has’ been formed for the purpose of raising
by subscription and contribution, a fund to erect on Libby’s
Hill, in Marshall park, in the city of Richmond, a monument
to commemorate the valor, patriotism, and deeds of private
soldiers and sailors of the late Confederate States of America;
and whereas it also appears that the said association has been
organized with the following officers, viz.: president, D. C.
Richardson; vice-presidents, George L. Christian, Robert S.
Bosher, Norman YV. Randolph, John 8. Ellett, Benjamin H.
Berry, and John A. Curtis; secretary, Carlton McCarthy ;
treasurer, William H.Cullingworth; board of directors, Wm.
J. Westwood, R.S. M. Valentine, J. B. Welsh, T. Wiley Davis,
J. C. Dickerson, R. L. Brown, Charles H. Hasker, James E.
Phillips, B. F. Cook, Beverly T. Crump, Jno. F. Mayer, John
H. Frischkorn, W. E. Cutshaw, James T. Ferriter, E. J.

1. Be it therefore enacted by the General Assembly of Vir-
inia, That the said D.C. Richardson, George L. Christian,

H. Cullingwortb, William J. Westwood, R. 8. N. Valentine,
J. B. Welsh, T. Wiley Davis, J. C. Dickerson, R. L. Brown,
Charles H. Hasker, James E. Phillips, B. F. Cook, Beverly
T. Crump, John F. Mayer, John H. Frischkorn, W. E. Cut-
shaw, James T. Ferriter, E. J. Levy, J. Taylor Ellyson,
Andrew Pizzini, jr., Sol. Cutchins, Charles V. Mercdith,
Lewis D. Crenshaw, jr. T. H. Ellett, Charles E. Wingo,
Tazewell Hilett, F. H. Habliston, E. D. Starke, William T.
Carrington, Charles L. Todd, E. A. Saunders, E. T. D. Myers,

Wilson, William J. Gentry, Thomas Cox, and John W. Beve-
ridge, and their successors in office and associates, be and
they are are hereby appointed a body politic and corporate,
under the name and style of the Confederate Soldiers’ and
Sailors’ Monument Association, and by that name and style
shall be subject to all the provisions and entitled to all the
rights, powers, privileges, and immunities prescribed by exist- |
ing laws in so far as the same may be applicable to like cor- |
porations and the purposes of said association, and are not
inconsistent with this act.
2. The said association shall have power to provide for’
representation in its general meetings and elections of the |
individual subscribers, to the fund raised by subscription; to
increase or diminish the number of its officers; to change
their designation and prescribe their duties; to appoint col-
lecting or other agents necessary for the accomplishment of
its objects and to hold them to a strict accountability; to
require.of said agents or any of its receiving or disbursing
officers, bonds with security, conditioned for the faithful per-
formance of their duties; and to make all needful by-laws and
regulations for the management of its property and the due
and orderly conduct of its affairs, which are not inconsistent
with the laws of this state.
3. It shall be lawful for said association to raise by sub-
scription and contribution such sum ot money as may be)
necessary for its purposes, and to acquire, by purchase or gift
within the corporate limits of the city of Richmond, a lot of
ground not to exceed one square as laid out in the plat of the
city, and to hold and improve the same for the purposes of
this association. Any lot of ground which may be acquired
under this section, shall be held sacred to the purposes of the
said association as recognized in this act, and such kindred
objects as the association may from time to time adopt, and
which may not be inconsistent with the laws of this state.
4. If the said association shall determine not to acquire a
separate lot in the city of Richniond for a location of the pro-
posed monument, then it shall be lawful for the said associa-
tion to erect the said monument on some public lot or square
in said city as may be agreed upon between it and the proper
authorities of said city. But the said association shall erect
said monument on Libby's hill or Marshall park if it is found
practicable to obtain a suitable lot for that purpose, either
under this or the preceding section of this act.
5. If from any cause the said association shall cease to exist
and not be revived within a reasonable time, the property
which may be acquired by it within the stato, shall revert to
the commonwealth of Virginia, and be held sacred to the pur-
poses for which it shall have been originally acquired.
6. This act shall be in force from its passage.
