Chap. 55.—An ACT permitting and authorizing the Charleston, Cin-
cinnati and Chicago railroad company to construct and operate its
road in Virginia.
Approved April 6, 1887,
Whereas the Charleston, Cincinnati and Chicago railroad
company, a corporation chartered by the laws of the State
of South Carolina, and the Rutherford railway construction
company, and the Rutherfordton, Marion and "Tennessee rail-
way corporations chartered by the laws of the State of
North Carolina, have been consolidated in contormity with
the statutes of said States. under the name of the Charleston,
Cincinnati and Chicavo Railroad Company; and whereas the
legislature of South Carolina has, by statute approved De-
cember twenty-fourth, cighteen hundred and elohty-six, re-
cognized, confirmed, and validated said consolidation; and
whereas the legislature of North Carolina has, by an act
ratificd the seventeenth of Febrn: ary, civhteen hundred and
eigbty-seven, also recognized, contirmed, and validated said
consolidation with its consolidation capital stock of fitteen
millions of dollars. and conferred additional powers on said
consolidated railroad company: and whereas the Charleston,
Cincinnati and Chicavo railroad company desires to extend
its road through the States of ‘Tennessee, Virginia and Ken-
tucky to the Ohio river, asa continuous line from the sea
coast to said river; now therefore
1. Beitenacted by the general assembly of Virginia, That
the Charleston, Cincinnati and Chicago railroad company is
hereby authorized and empowered to extend, construct, and
operate its road from a point on the State line of Tennessee
by the most practicable route through or across the State of
Virginia, to some point on the State line of Kentucky at or
near the breaks of Sandy, and to that end may enter upon
lands, and survey its route and condemn lands for tracks,
depots, machine shops, and other appurtenances, as provided
in the general law of the State, applicable to other like cor-
porations.
2. That said corporation may sue and be sued, contract
and be contracted with, and convey, purchase, and receive by
gift or otherwise, real and personal property by its corporate
name, and have a common seal, and exercise all the general
powers of a corporation of like kind; provided that should
it ever consolidate with a foreign cor por ation, the consolidated
company shall always remain a Virginia corporation as re-
gards the right of suing and being sued. It may execute
mortgages on its-property and franchises to secure its debts;
it may purchase or lease any other railroad, or purchase the
stock or bonds of any other corporate company, or guarantee
the stock and bonds of any other railroad corporation, or
consolidate with any other railroad company or companies
chartered in this or any other State, or lease or farm out its
road and property, or the right of transportation over it; it
may construct branches to any place, mine or manufactory
in the counties of Tazewell, Scott, Wise, Buchanan, Dicken-
son, Russell, Washington, and Lee, where the tonnage and
income will justify their construction: provided, howe ever,
that no branch hereby authorized, shall be built, nor the right
of way acquired for such brane h till after the main line has
been constructed and is ready for the running of trains
through the State of Virginia, from Tennessee to ‘Kentucky,
on such line us the company may adopt for its main line:
and provided further, that the said railroad company and
its successors shall not have the right to the exclusive occu-
pancy of any mountain pass In any of the counties reterred
to in this act, where it is practicable to construct and operate
more than one railroad, and may construct and operate tele-
graph Jines along or near its right of way, or contract with
other persons or corporations to construct or operate the
same, or contract for the use and operation of telephones and
other like apparatus.
3. Itisayreed that this company shall always pay its taxes
in gold, silver, or United States currenc y, and not in coupons.
#. That said company shall have all the powers and privi-
lees conferred on other railroad companies by the general
laws of the State, and that said railroad company shall begin
construction of said road within two years from the passage
of this act, and have it ready for running cars within four
years.
9. This act shall be in force from and after its passage.
