Chap. 258.—An ACT to amend and re-enact the charter of Stephen
City, Frederick county, Virginia.
Approved May 16, 1887.
1. Be it enacted by the general assembly of Virginia, That
the corporate limits and bountlaries of the town of’ Newtown.
Stephensburg, Irederick county, Virginia, shall be and re-
main as they now are and have heretofore been established
by law, and be called and constitute the town of Stephens
City.
2. The municipal authorities of said town shall consist ot
a mayor and four councilmen, who shall be elected annually
by ballot on the fourth Thursday in May, at some convenient
place in said town, by the voters of said town qualified to
vote in State elections, and the said officers so as aforesaid
clected must be qualified to vote as aforesaid, and shall hold
office for one year from the first day of July in each year,
and until their successors be elected and duly qualified in
oftice. The mayor and councilmen shall each, before enter-
ing upon the duties ot their office, takean oath oraflirmation be-
tore a justice of the peace for the county of Frederick, that,
he will faithfully and impartialy to the best of his judement
perform the duties of his oftice.
3. The mayor and council, so clected, any three of whom
shall constitute a quorum, shi: ll have power to make by-laws
and ordinances for the regulation and good government of
the said town, and to assess and collect taxes on the inhabi-
tants and property within the limits of the said town for the
charge of repairing, opening, or cleaning the streets and
other municipal purposes, subject to the limitations and re-
strictions of the general law of the State regulating towns.
4. The mayor and council, so elected, shall elect by ballot
and appoint a town sergeant, who shall, within the limits of
said town and within one mile circumjacent thereto, bea
conservator of the peace, and have all the powers and duties
of a constable to execute the ordinances and regulations of
the said town, and be removable from office by the mavor.,
The mavor and councilmen, so elected, shall be ex-ollicio
conservators of the peace, whose policial Jurisdiction shall
xtend within the limits of the said town and for one viile
circumjacent thereto; and the mayor shall have power and
jurisdiction to bear and determine all questions of breach of
the peace, subject to the meht of appeal as prescribed by law,
and of breach’ or violation of the ordinances and recul: tions
of said town, and to Impose and entorce the collection of
fines and penalties therefor, subject to the general law of the
State regulating the collection of such pe wnalties and fines.
5. Inthe event of the death, resignation, or removal out
of said town of said mayor and any of said councilmen, such
vacapcy shall be supplied within twenty days by an election
held as aforesaid, by the qualitied voters of said town, the
date of the election to supply such vacancy to be fixed by the
mayor of said town, or in case of bis death, resignation, or
removal, by the aldermen of said town.
6. The municipal authorities of said town of Stephen City
shall have the use of the jail of the county of Frederick in
execution and entorcement of their duties of office under this
act, and by the general laws of the commonwealth regulating
the same.
7. All acts or portions of acts inconsistent with this act
are hereby repealed.
8. This act shall be in force from its passage.
