Chap. 253.—An ACT to repair and keep in order the roads in the
county of Lancaster.
Approved May 16, 1887,
1. Be it enacted by the general assembly of Virginia, That
the board of supervisors of the county of Lancaster shall
annually, at the time of laying the county levy for said
county, make an estimate of the probable and necessary ex-
penses of working the public roads in each magisterial dis-
trict in said county for the next ensuing year, and levy a
road tax not exceeding, after the first year, fifteen cents on
the one hundred dollars of assessed taxable values in said
county, to be collected, accounted for and paid out upon the
warrant of said board in all respects as if it were a county
levy fixed by the board, except that the fund collected from
each magisterial district shall be kept separate by the county
treasurer, and a different rate of tax may be prescribed for
different districts. The amount collected in cach district
shall be expended in that district.
2. It shall be the duty of the county judyve of Lancaster
county, at the October term of his court, or as soon there-
after as practicable, to appoint in cach magisterial district
some suitable person as commissioner of roads, who shall
qualify by taking the usual oath of office. The term of said
commissioner shall be one year, commencing on the first day
of January ensuing. The judge shall also be authorized and
required to fill any vacancy that may occur in the office of
commissioner of roads.
3. It shall be the duty of each of said commissioners to
provide the necessary tools and implements for working the
the roads; to hire laborers and teams; to supcrintend the
work, and keep the roads in as good repair as the funds at his
command will enable him to do, and from time to time lay
his accounts, verified by oath, before the board of supervisors
for a draft on the county treasurer, but in no case to exceed
the road tax in his district. For failure to perform bis duties
he shall be liable to presentment or indictment by the grand
jury, and may be removed from office by the judge for good
cause.
4. The compensation for said commissioner of roads shall
be two dollars per diem for each day actually engaged, to be
paid out of the road tax for his district on the approval and
warrant of the supervisors, and it shall be his duty to present
asworn statement of the actual time employed by him in
attendance to the duties of his office. Such provisions of
the general road law of the State as do not conflict with this
act shall continue in force in said county of Lancaster.
6. All acts and parts of acts in conflict with this act are
hereby repealed. |
7. This act shall be in force from its passage.
