Chap. 80.—An ACT to amend and re-enact section 6 of chapter 840
the Code of Virginia, in relation to public health.
Approved February 5, 1886.
1. Be it enacted by the general assembly of Virginia, Tha
section six of chapter eighty-four of the Code of Virginia, edi
tion of eighteen hundred and seventy-three, be amended anc
re-enacted, so as to read as follows: :
§ 6. The council of any town, or the court of any county
may establish in such county, or in or near such town, hospi
tals, which shall be subject to regulations, not contrary to law.
made by such council or court: provided, however, that the
council of any city or town desiring to locate such hospital in
side of the limits bf their corporation must first obtain the con.
sent of the county court and of the board of supervisors of thi
county in which they propose to locate, as to the site to be se
lected for the hospital; and any person whose property is in.
jured by the location of such hospital shall be paid by the coun
eil of the town or the board of supervisors of the county, sc
locating the said hospital, the amount of damages done to thei
property; and in the event of the failure of such council o:
board of supervisors to make such payment, or of their failur
to agree upon the amount of damages done, then it shall be
lawful for any person whose property is so damaged by the lo
cation of such hospital to recover from the county, city or town
so locating said hospital, the damages done to their property
said damages to be recovered by proper action in the circuit
court of the county in which said hospital is located.
2. All acts and parts of acts inconsistent with this act are
hereby repealed.
3. This act shall be in force from its passage.
